1.                                         Vide impugned order dated 22.08.2006 passed by the District Forum, the appellant has been directed to revise its demand at agreed rate of Rs.2/- per sq. yards of the plot size of the respondent without LPSC.

2.                                         Grievance of the appellant in short is that during the intervening period rates were revised by the company and therefore revised bill on the basis of the agreed rate of Rs.2/- per sq. yards could not be raised.

3.                                         This plea of the appellant has been well taken care of by the District Forum with the observation that in several other cases the District Forum has held that the appellant cannot arbitrarily revise the rate without clearance from D.E.R.C. and without issuing notification in this regard and without bringing it to the notice of the concerned consumer.

4.                                         We do not find any infirmity in the said observation and therefore dismiss the appeal in limine being devoid of merit.

5.                                         Bank Guarantee/FDR, if any, furnished by the appellant be returned forthwith.

6.                                         A copy of this order as per the statutory requirements be forwarded to the parties free of charge and also to the concerned District Forum and thereafter the file be consigned to Record Room.
