​case​​has​​been​​entrusted​​to​​this​​Bench​​by​​the​​Hon'ble​ ​Chairman​​under​​Section​​26​​of​​the​​Administrative​​Tribunals​​Act,​​1985​​for​ ​Third​ ​Member​ ​Reference​ ​on​ ​account​ ​of​​difference​​of​​opinion​​in​​order​​of​ ​the Division Bench of this Tribunal.​ ​2.​ ​The applicant has sought the following reliefs:​ ​a)​ ​To​ ​declare​ ​that​ ​the​ ​applicant​ ​is​ ​entitled​ ​for​ ​the​ ​benefit​ ​of​ ​Pay​ ​Protection as per FR-22-B(1);​ 2025.10.27 SHIVAM 16:00:47 Z00'00' ​2​ ​(O.A.No. 060/192/2022)​ ​b)​ ​To​ ​quash​ ​&​ ​set​ ​aside​ ​the​ ​impugned​ ​Orders​ ​dated​ ​18.11.2021(ANNEXUREA-18);​​dated​​15.12.2021​​(ANNEXURE​​A-​​20​ ​and Order dated 10.2.2022 (ANNEXUREA-22);​ ​c)​​To​​direct​​respondent​​no.​​3​​to​​make​​necessary​​entries​​in​​records​ ​regarding marking of lien of the applicant​ ​d)​ ​To​ ​direct​ ​respondent​ ​no.​ ​2​ ​to​ ​grant​ ​Pay​ ​Protection​ ​to​ ​the​ ​applicant​​w.e.f.​​10.7.2017,​​the​​day​​the​​applicant​​joined​​in​​PGIMER,​ ​Chandigarh,​ ​by​ ​re-fixing​ ​the​ ​Basic​ ​Pay​ ​of​ ​the​ ​applicant​ ​as​ ​Rs.59500/-​ ​and​ ​pay​ ​arrears​ ​of​ ​pay,​ ​allowances​ ​and​ ​consequential​ ​benefits.​ ​3.​ ​Facts​​of​​the​​case​​in​​brief​​are​​as​​follows.​​The​​applicant​​joined​​Guru​ ​Gobind​ ​Singh​ ​Medical​ ​College​ ​and​ ​Hospital,​ ​Faridkot,​ ​a​ ​constituent​ ​college​ ​of​ ​Baba​ ​Farid​ ​University​ ​of​ ​Medical​ ​Sciences​ ​[BFUHS]​ ​Faridkot,​ ​as​ ​Nuclear​ ​Medicine​ ​Physicist​ ​on​ ​13.08.2014.​ ​While​ ​working​ ​as​ ​aforesaid,​ ​she​ ​applied​ ​for​ ​the​ ​post​ ​of​ ​Nuclear​ ​Medicine​ ​Physicist​ ​in​ ​PGIMER​ ​Chandigarh​ ​through​ ​proper​ ​channel​ ​on​ ​29.04.2016​ ​(Annexure​ ​A-2).​​The​​BFUHS,​​Faridkot​​issued​​NOC​​to​​the​​applicant​​dated​​17.5.2016​ ​to​ ​apply​ ​for​ ​the​ ​post​ ​of​ ​Nuclear​ ​Medicine​ ​Physicist​ ​in​ ​PGIMER​ ​Chandigarh​ ​(Annexure​ ​A-3).​ ​She​ ​submitted​ ​Three​ ​Months​ ​Notice​​dated​ ​10.06.2017​ ​to​ ​BFUHS,​ ​Faridkot​ ​for​ ​resigning​ ​from​ ​the​ ​post​ ​held​ ​there​ ​(Annexure​ ​A-4).​ ​The​ ​Vice​ ​Chancellor​ ​BFUHS,​ ​Faridkot​ ​accepted​ ​the​ ​resignation​​tendered​​by​​the​​applicant.​​She​​was​​permitted​​to​​be​​relieved​ ​from​ ​Guru​ ​Gobind​ ​Singh​ ​Medical​ ​College​ ​&​ ​Hospital/BFUHS​ ​on​ ​06.07.2017​ ​(Annexure​ ​A-7).​ ​She​ ​joined​ ​the​ ​PGIMER,​ ​Chandigarh​ ​as​ ​Nuclear​ ​Medicine​ ​Physicist​ ​w.e.f.​ ​10.07.2017.​ ​Her​ ​pay​ ​was​ ​fixed​ ​@​ ​Rs.56100/-​ ​i.e.​ ​at​ ​the​ ​minimum​ ​of​ ​the​ ​Pay​ ​Band​​of​​Rs.15600-39100​​+​ ​G.P.​ ​Rs.5400/-.​ ​The​ ​grievance​ ​of​ ​the​ ​applicant​ ​is​ ​that​ ​she​ ​earned​ ​two​ 2025.10.27 SHIVAM 16:00:47 ​increments​ ​while​ ​working​ ​with​ ​BFUHS​​and​​was​​getting​​the​​higher​​basic​ Z00'00' ​pay​​of​​Rs.16880/-,​​but​​the​​PGIMER,​​Chandigarh​​while​​fixing​​her​​pay​​did​ ​not grant her the benefit of pay protection.​ ​3​ ​(O.A.No. 060/192/2022)​ ​4.​ ​Feeling​ ​aggrieved,​ ​the​ ​applicant​ ​represented​ ​to​ ​the​ ​Director​ ​PGIMER​ ​Chandigarh​ ​for​ ​Pay​ ​Protection​ ​vide​ ​letter​ ​dated​ ​28.7.2017​ ​(Annexure​ ​A-11),​ ​followed​ ​by​ ​reminders​ ​dated​ ​10.1.2018,​ ​10.9.2020​ ​and​ ​02.08.2021​ ​(Annexures​ ​A-12​ ​to​ ​A-15).​ ​Pursuant​ ​thereto,​ ​the​ ​respondents​ ​no.​ ​2​ ​wrote​ ​to​ ​respondent​ ​no.​ ​3​ ​i.e.​ ​BFUHS,​​Faridkot​​vide​ ​letter​ ​dated​ ​09.09.2021​ ​(Annexure​ ​A-15)​ ​with​ ​reference​ ​to​ ​the​ ​applications​​of​​the​​applicant.​​The​​respondent​​no.​​3​​responded​​vide​​letter​ ​dated​​18.11.2021​​(Annexure​​A-18)​​stating​​that​​lien​​of​​the​​applicant​​was​ ​not​ ​retained​ ​as​ ​she​ ​did​ ​not​ ​give​ ​any​ ​option​ ​for​ ​retention​ ​of​ ​lien​ ​while​ ​submitting​ ​her​ ​technical​ ​resignation​ ​to​ ​them.​ ​Consequently,​ ​the​ ​Administrative​​Officer,​​PGIMER,​​Chandigarh​​vide​​letter​​dated​​15.12.2021​ ​(Annexure​​A-20)​​rejected​​the​​request​​of​​the​​applicant​​for​​pay​​protection​ ​in​ ​the​ ​absence​ ​of​ ​retention​ ​of​ ​lien​ ​by​ ​her​ ​previous​ ​employer.​ ​The​ ​applicant​ ​again​ ​represented​ ​to​ ​the​​PGIMER​​Chandigarh​​vide​​application​ ​dated​ ​05.01.2022​ ​(Annexure​ ​A-21),​ ​which​ ​was​ ​rejected​ ​vide​ ​letter​ ​dated​ ​10.02.2022(Annexure​ ​A-22)​ ​on​ ​the​ ​lines​ ​of​ ​earlier​ ​letter​ ​dated​ ​15.12.2021.​ ​5.​ ​The​ ​contention​ ​of​ ​the​ ​applicant​ ​is​ ​that​ ​she​​is​​fully​​eligible​​for​​the​ ​benefit​ ​of​ ​pay​ ​protection,​ ​which​ ​she​ ​was​ ​getting​ ​from​ ​her​ ​previous​ ​employer in terms of instructions and guidelines issued by the DoP&T.​ ​6.​ ​In​ ​reply,​ ​it​ ​is​ ​submitted​ ​by​ ​Respondent​ ​Nos.​ ​1​ ​and​ ​2​ ​that​ ​as​​per​ ​DoPT​ ​OM​ ​dated​ ​05.08.2020​ ​specifies​ ​that​ ​under​ ​FR​​22​​(B)​​(1)​​shall​​be​ ​available​ ​to​ ​the​ ​Government​ ​servant​ ​if​ ​he​ ​holds​ ​a​ ​lien​ ​on​ ​his​ ​previous​ ​permanent​ ​post.​ ​Upon​ ​examination,​ ​it​ ​was​ ​intimated​ ​by​ ​previous​ ​employer​ ​of​ ​the​ ​applicant​ ​i.e.​ ​BFHUS​​vide​​letter​​dated​​18.11.2021​​that​ ​since​​the​​applicant​​did​​not​​give​​any​​option​​regarding​​retention​​of​​lien​​at​ ​the​ ​time​ ​of​ ​technical​ ​resignation​ ​from​ ​the​ ​post​ ​of​ ​Nuclear​ ​Medicine​ 2025.10.27 SHIVAM 16:00:47 ​Physicist​ ​at​ ​BFHUS,​ ​her​​lien​​was​​not​​retained,​​and​​accordingly​​in​​terms​ Z00'00' ​of​ ​instructions/provisions​ ​laid​ ​down​ ​in​ ​OA​ ​dated​ ​05.08.2020​ ​read​ ​with​ ​4​ ​(O.A.No. 060/192/2022)​ ​FR​ ​22​ ​(B)​ ​(1),​ ​her​ ​request​ ​for​ ​pay​ ​protection​ ​was​ ​not​ ​acceded​ ​to​ ​and​ ​the same was conveyed to her vide letter dated 15.12.2021.​ ​7.​ ​Respondent​ ​No.​ ​3​ ​have​ ​submitted​ ​that​ ​the​ ​applicant​ ​did​​not​​give​ ​any​ ​option​ ​regarding​ ​retaining​ ​of​ ​lien​ ​at​ ​the​ ​time​ ​of​ ​rendering​ ​her​ ​technical​ ​resignation,​ ​and​ ​therefore​ ​her​ ​lien​ ​was​ ​not​ ​retained.​ ​Respondent​ ​No.​ ​3​ ​has​ ​relied​ ​upon​ ​provisions​ ​of​ ​Punjab​ ​Civil​ ​Services​ ​Rule,​ ​Volume-I,​ ​Part-I,​ ​Chapter​ ​3​ ​clause​ ​3.12​ ​to​ ​support​ ​their​ ​contention.​ ​8.​ ​I​ ​have​ ​heard​ ​arguments​ ​addressed​ ​by​ ​learned​ ​counsel​ ​for​ ​both​ ​sides and carefully perused the pleadings and the relevant annexures.​ ​9.​ ​It​ ​is​ ​undisputed​ ​fact​ ​that​ ​the​ ​applicant​ ​initially​ ​joined​ ​the​ ​Guru​ ​Gobind​ ​Singh​ ​Medical​ ​College​ ​and​ ​Hospital,​ ​Faridkot/Baba​ ​Farid​ ​University​ ​of​ ​Health​ ​Sciences,​ ​Faridkot​ ​on​ ​13.08.2014​ ​as​ ​Nuclear​ ​Medicine​ ​Physicist​ ​in​ ​the​​pay​​scale​​of​​Rs.15600-39100​​with​​5400​​(G.P.)​ ​on​ ​regular​​basis.​ ​She​​applied​​for​​the​​post​​of​​Medical​​Physicist​​(Nuclear​ ​Medicine)​ ​in​ ​PGIMER​ ​Chandigarh​ ​in​ ​the​ ​year​ ​2016​ ​through​ ​proper​ ​channel​ ​in​ ​response​ ​to​ ​Advertisement​ ​No.​ ​PGI/RC/039​ ​dated​ ​16.04.2016.​ ​The​ ​Respondent​ ​No.​ ​3​ ​issued​​'No​​Objection​​Certificate'​​to​ ​the​ ​applicant​ ​for​ ​applying​ ​for​ ​the​ ​post​ ​of​ ​Nuclear​ ​Medicine​ ​Physicist​ ​in​ ​PGIMER,​​Chandigarh​​vide​​letter​​dated​​17.05.2016.​ ​On​​her​​selection​​in​ ​the​​PGI,​​the​​applicant​​submitted​​three​​months​​notice​​of​​resignation​​with​ ​effect​​from​​10.06.2017​​to​​the​​Respondent​​No.​​3,​​which​​was​​accepted​​by​ ​the​ ​Competent​ ​Authority.​ ​She​ ​was​ ​allowed​ ​to​ ​be​ ​relieved​ ​w.e.f.​ ​27.06.2017.​ ​However,​ ​she​ ​was​ ​formally​ ​relieved​ ​vide​ ​letter​ ​dated​ ​06.07.2017.​ ​She​ ​joined​ ​the​ ​PGIMER,​ ​Chandigarh​ ​on​ ​10.07.2017​ ​as​ ​Nuclear Medicine Physicist on regular basis.​ ​10.​ ​Though,​ ​the​ ​applicant​ ​earned​ ​two​ ​increments​ ​in​ ​the​​relevant​​pay​ 2025.10.27 SHIVAM 16:00:47 ​scale​ ​while​ ​working​ ​with​ ​the​ ​Respondent​ ​No.​ ​3,​ ​but​ ​the​ ​applicant​ ​has​ Z00'00' ​not​ ​been​ ​granted​ ​the​ ​benefit​ ​of​ ​pay​ ​protection​ ​on​ ​the​ ​ground​ ​that​ ​her​ ​lien​ ​was​ ​not​ ​retained​ ​by​ ​his​ ​previous​ ​employer​ ​i.e.​ ​Respondent​ ​No.​ ​3​ ​5​ ​(O.A.No. 060/192/2022)​ ​and​ ​therefore,​ ​in​ ​the​ ​absence​ ​of​ ​retention​ ​of​ ​lien​ ​in​ ​the​ ​previous​ ​department,​ ​the​ ​applicant​ ​is​ ​not​ ​entitled​ ​to​ ​pay​ ​protection​ ​in​ ​the​ ​new​ ​department​ ​i.e.​ ​PGIMER​ ​Chandigarh.​ ​The​ ​request​ ​of​ ​the​ ​applicant​ ​has​ ​been rejected by the Respondent No. 2 vide letter dated 15.12.2021.​ ​11.​ ​It​ ​is​ ​further​ ​undisputed​ ​that​ ​the​​applicant​​applied​​through​​proper​ ​channel​ ​and​ ​submitted​ ​Technical​ ​resignation​ ​to​​Respondent​​No.​​3​​upon​ ​being​ ​selected​ ​in​ ​the​ ​PGIMER,​​Chandigarh.​ ​A​​resignation​​submitted​​by​ ​an​ ​employee​ ​entails​ ​the​ ​forfeiture​ ​of​ ​entire​ ​past​ ​service,​ ​as​ ​per​ ​rules.​ ​However,​ ​the​ ​Technical​ ​Resignation​ ​is​ ​an​ ​exception​ ​to​ ​this​ ​situation.​ ​Relevant​ ​portion​​of​​the​​technical​​resignation​​submitted​​by​​the​​applicant​ ​dated 10.06.2017 (A-4) reads as under:​ ​"​​It​​is​​humbly​​stated​​that​​I​​am​​working​​as​​Nuclear​​Medicine​​Physicist​ ​on​ ​regular​ ​basis​ ​since​ ​13.09.2024​ ​(​ ​A/N)​ ​in​ ​the​ ​Department​ ​of​ ​Nuclear​​Medicine,​​GGMC&H.​​I​​applied​​for​​the​​post​​of​​Medical​​Physicist​ ​(​ ​Nuclear​ ​Medicine​ ​)​ ​on​ ​pay​ ​scale​ ​of​ ​15600-39100​ ​GP-6400​ ​at​ ​PGIMER,​ ​Chandigarh​ ​vide​ ​Advt​ ​No.​ ​PGI/RC/039/2016​ ​dated​ ​16.04.2016​ ​after​ ​obtaining​ ​NOC​ ​for​ ​the​ ​same​ ​from​ ​BFHUS​ ​and​ ​got​ ​selected​ ​for​ ​the​ ​same​ ​copy​ ​of​ ​result​ ​is​ ​enclosed,​ ​herewith​ ​for​ ​your​ ​ready reference.​ ​May​ ​I​ ​request​ ​you​ ​to​ ​accept​ ​three​ ​month​ ​notice​ ​of​​resignation​​from​ ​the post of Nuclear Medicine Physicist w.e.f. 10.06.22017 ( F/N)."​ ​12.​ ​The​ ​State​ ​of​ ​Punjab​ ​issued​ ​the​ ​instructions​ ​dated​ ​19.02.2016​ ​on​ ​the​ ​subject​ ​of​ ​Technical​ ​Resignation​ ​reiterating​ ​the​ ​instructions​ ​issued​ ​by​ ​the​ ​Government​ ​of​ ​India,​ ​Ministry​ ​of​ ​Personnel,​ ​Public​ ​Grievances​ ​and​ ​Pension,​ ​Department​ ​of​ ​Personnel​ ​and​ ​Training,​ ​New​ ​Delhi​ ​vide​ ​letter​ ​dated​ ​26.12.2013​ ​and​ ​it​ ​has​ ​been​ ​specifically​ ​mentioned​ ​therein​ ​that​ ​these​ ​instructions​ ​would​ ​be​ ​applicable​ ​to​ ​the​ ​employees​ ​of​ ​Government​ ​of​ ​Punjab.​ ​The​ ​relevant​ ​para​ ​of​ ​these​ ​instructions​ ​are​ ​extracted hereunder for better understanding:-​ 2025.10.27 SHIVAM 16:00:47 Z00'00' ​6​ ​(O.A.No. 060/192/2022)​ ​"13.​​A​​resignation​​from​​the​​service​​or​​post​​entails​​forfeiture​​of​​entire​ ​past​ ​qualifying​ ​service.​ ​The​​exception​​is​​technical​​resignation​​which​ ​does not result in forfeiture of past service.​ ​14.​ ​In​ ​cases​ ​where​ ​a​ ​Government​ ​Servant​ ​applied​ ​for​ ​post​ ​in​ ​the​ ​same​ ​or​ ​the​ ​other​ ​Department​ ​through​ ​proper​ ​channel​ ​and​ ​on​ ​selection,​ ​is​ ​required​ ​to​ ​resign​ ​the​ ​previous​ ​post​ ​for​ ​administrative​ ​reasons,​​the​​benefit​​of​​past​​service,​​if​​otherwise​​admissible​​under​​the​ ​rules,​ ​is​ ​given​ ​treating​ ​the​ ​resignation​ ​as​ ​a​ ​"Technical​ ​Formality".​ ​Resignation​​submitted​​for​​other​​reasons​​or​​if​​the​​competent​​authority​ ​has​ ​not​ ​allowed​ ​him​ ​to​ ​forward​ ​his​ ​application​ ​through​ ​proper​ ​channel​ ​is​ ​a​ ​resignation​ ​and​ ​benefit​ ​of​ ​past​ ​service​ ​will​ ​not​ ​be​ ​admissible.​ ​15.​ ​This​ ​benefit​ ​is​ ​also​ ​admissible​ ​to​ ​Government​ ​servants​ ​who​ ​applied​ ​for​ ​posts​ ​in​ ​same​ ​or​ ​other​ ​Departments​ ​before​ ​joining​ ​Government​ ​service​ ​and​ ​on​ ​that​ ​account​ ​the​ ​application​ ​was​ ​not​ ​routed​​through​​proper​​channel.​​The​​benefit​​of​​past​​service​​is​​allowed​ ​in such cases subject to the fulfilment of the following conditions:​ ​(i)​ ​the​ ​Government​ ​servant​ ​at​ ​the​ ​time​ ​of​ ​joining​ ​should​ ​intimate​ ​the details of such application immediately on their joining.​ ​(ii)​ ​the​ ​Government​ ​servant​ ​at​ ​the​ ​time​ ​of​ ​resignation​ ​should​ ​specifically​​make​​a​​request​​indicating​​that​​he​​is​​resigning​​to​​take​​up​ ​another​ ​appointment​ ​under​ ​Government/Government​ ​organisation​ ​for​​which​​he​​applied​​before​​joining​​the​​Government​​service​​and​​that​ ​his resignation may be treated a technical resignation.​ ​(iii)​​the​​authority​​accepting​​the​​resignation​​should​​satisfy​​itself​​that​ ​had​​the​​employee​​been​​in​​service​​on​​the​​date​​of​​application​​for​​the​ ​post​ ​mentioned​ ​by​ ​the​ ​employee,​ ​his​ ​application​ ​would​ ​have​ ​been​ 2025.10.27 SHIVAM 16:00:47 ​forwarded through proper channel.​ Z00'00' ​2.​ ​It​ ​has​ ​been​ ​decided​ ​that​ ​the​ ​above​ ​provisions​ ​shall​ ​also​ ​be​ ​applicable for the employees of Government of Punjab."​ ​7​ ​(O.A.No. 060/192/2022)​ ​From​​the​​reading​​of​​aforesaid​​instructions,​​it​​is​​evident​​that​​the​​State​​of​ ​Punjab​ ​has​ ​adopted​​the​​instructions​​issued​​by​​the​​Government​​of​​India​ ​dated​ ​26.12.2013.​ ​They​ ​don't​ ​have​ ​any​ ​specific​ ​instructions​ ​on​ ​'Technical​ ​Resignation'.​ ​It​ ​has​ ​been​ ​explicitly​ ​mentioned​ ​that​ ​a​ ​resignation​ ​from​ ​service​ ​or​ ​post​ ​entails​ ​the​ ​benefit​ ​of​ ​entire​ ​past​ ​qualifying​ ​service.​ ​But​ ​there​ ​is​ ​exception​ ​to​ ​this​ ​situation​ ​i.e.​ ​the​ ​technical resignation, which does not result in forfeiture of past service.​ ​13.​ ​These​ ​guidelines/instructions​ ​on​ ​Technical​ ​Resignation​ ​and​ ​Lien​ ​issued​ ​by​ ​the​ ​Government​​of​​India,​​DoP&T,​​from​​time​​to​​time​​including​ ​26.12.2013​ ​have​ ​been​ ​consolidated​ ​vide​ ​OM​ ​dated​​17.08.2016.​ ​These​ ​instructions/guidelines​ ​would​ ​also​ ​apply​ ​to​ ​the​ ​employees​ ​of​ ​Punjab​ ​in​ ​view​ ​of​ ​instructions​ ​dated​ ​19.02.2016​ ​issued​ ​by​ ​the​ ​Government​ ​of​ ​Punjab.​​In​​this​​context,​​the​​relevant​​para​​2.1​​of​​O.M.​​dated​​17.08.2016​ ​issued by the DoP&T would be relevant to extract hereunder:-​ ​2.1​​As​​per​​the​​Ministry​​of​​Finance​​O.M.​​No.​​3379-E.​​III​​(B)/65​​Dated​ ​the​ ​17th​ ​June,​ ​1965,​ ​the​ ​resignation​ ​is​ ​treated​ ​'technical​ ​formality'​ ​where​​a​​Government​​Servant​​has​​applied​​through​​proper​​channel​​for​ ​a​ ​post​ ​in​ ​the​ ​same​ ​or​ ​some​ ​other​ ​Department,​ ​and​ ​is​ ​on​ ​selection,​ ​required​ ​to​ ​resign​ ​the​ ​previous​ ​post​ ​for​ ​administrative​ ​reasons.​​The​ ​resignation​ ​will​ ​be​ ​treated​ ​as​ ​Technical​ ​resignation,​ ​if​ ​these​ ​conditions​ ​are​ ​met,​ ​even​ ​if​ ​the​ ​Government​ ​Servant​ ​has​ ​not​ ​mentioned​​the​​word​​"Technical"​​while​​submitting​​his​​resignation.​​The​ ​benefit​ ​of​ ​past​ ​service,​ ​if​ ​otherwise​ ​admissible​ ​under​ ​Rules,​​may​​be​ ​given in such cases.​ ​Further,​ ​as​ ​per​ ​instructions,​ ​the​ ​technical​ ​resignation​​shall​​not​​result​​in​ ​the​​lapse​​of​​leave​​to​​the​​credit​​of​​the​​Government​​servant.​​The​​para​​2.2​ ​deals​ ​with​ ​the​ ​situation​ ​in​ ​which​ ​the​ ​leave​ ​benefit​ ​will​ ​be​ ​carried​ ​forward. The paras relevant to the issue in hand are quoted hereunder:-​ ​"2.4​ ​Pay​ ​Protection,​ ​eligibility​​of​​past​​service​​for​​reckoning​​of​ ​the minimum period for grant of Annual Increment​ 2025.10.27 SHIVAM 16:00:47 ​In​ ​cases​​of​​appointment​​of​​a​​Government​​servant​​to​​another​​post​​in​ Z00'00' ​Government​​on​​acceptance​​of​​technical​​resignation,​​the​​protection​​of​ ​pay​ ​is​ ​given​ ​in​ ​terms​ ​of​ ​the​ ​Ministry​ ​of​ ​Finance​ ​OM​ ​No.​ ​3379-E.III​ ​8​ ​(O.A.No. 060/192/2022)​ ​(B)/65​ ​dated​ ​the​ ​17​ ​th​ ​June,​ ​1965​ ​read​ ​with​ ​proviso​ ​to​ ​FR​ ​22-B.​ ​Thus,​​if​​the​​pay​​fixed​​in​​the​​new​​post​​is​​less​​than​​his​​pay​​in​​the​​post​ ​he​ ​holds​ ​substantively,​ ​he​ ​will​ ​draw​ ​the​​presumptive​​pay​​of​​the​​pay​ ​he​ ​holds​ ​substantively​ ​as​ ​define​ ​in​ ​FR-9(24).​ ​Past​ ​service​ ​rendered​ ​by​​such​​a​​Government​​servant​​is​​taken​​into​​account​​for​​reckoning​​of​ ​the​ ​minimum​ ​period​ ​for​ ​grant​ ​of​ ​annual​ ​increment​ ​in​ ​the​​new​​post/​ ​service/​​cadre​​in​​Government​​under​​the​​provisions​​of​​FR​​26​​read​​with​ ​Rule​ ​10​ ​of​ ​CCS​ ​(RP)​ ​Rules,​ ​2016.​ ​In​ ​case​ ​the​ ​Government​ ​servant​ ​rejoins​ ​his​ ​earlier​ ​posts,​ ​he​ ​will​ ​be​ ​entitled​ ​to​ ​increments​ ​for​ ​the​ ​period of his absence from that post.​ ​3.1 Lien​ ​3.1.1​ ​Lien​ ​is​ ​defined​ ​in​ ​FR​ ​9(13).​ ​It​ ​represents​ ​the​ ​right​ ​of​ ​a​ ​Government​​employee​​to​​hold​​a​​regular​​post,​​whether​​permanent​​or​ ​temporary,​​either​​immediately​​or​​on​​the​​termination​​of​​the​​period​​of​ ​absence.​ ​The​ ​benefit​ ​of​ ​having​ ​a​ ​lien​ ​in​ ​a​ ​post/service/cadre​ ​is​ ​enjoyed​ ​by​ ​all​ ​employees​ ​who​ ​are​ ​confirmed​ ​in​ ​the​ ​post/service/cadre​ ​of​ ​entry​ ​or​ ​who​ ​have​ ​been​ ​promoted​ ​to​ ​a​​higher​ ​post,​ ​declared​ ​as​ ​having​ ​completed​ ​the​ ​probation​ ​where​ ​it​ ​is​ ​prescribed.​ ​It​ ​is​ ​also​ ​available​​to​​those​​who​​have​​been​​promoted​​on​ ​regular​​basis​​to​​a​​higher​​post​​where​​no​​probation​​is​​prescribed​​under​ ​the rules, as the case may be.​ ​3.1.2​ ​The​ ​above​​right​​will,​​however,​​be​​subject​​to​​the​​condition​​that​ ​the​ ​junior-most​ ​person​ ​in​ ​the​ ​cadre​ ​will​ ​be​ ​liable​ ​to​ ​be​ ​reverted​ ​to​ ​the​​lower​​post/service/cadre​​if​​at​​any​​time​​the​​number​​of​​persons​​so​ ​entitled is more than the posts available in that cadre/service.​ ​(DOPT's O.M.No.1801 1/1/86-Eatt (D) dated 28.03.1998) 1.1998)​ ​3.2 Lien on a post​​.​ ​A​ ​Government​ ​servant​ ​who​ ​has​ ​acquired​ ​a​ ​lien​ ​on​ ​a​ ​post​ ​retains​ ​a​ ​lien on that post-​ ​(a)​ ​while performing the duties of that post;​ ​(b)​ ​while​ ​on​ ​foreign​ ​service,​ ​or​ ​holding​ ​a​ ​temporary​ ​post​ ​or​ ​officiating in another post;​ ​(c)​ ​during​ ​joining​ ​time​ ​on​ ​transfer​ ​to​ ​another​ ​post;​ ​unless​ ​he​ ​is​ ​transferred​ ​substantively​ ​to​ ​a​ ​post​ ​on​ ​lower​ ​pay,​ ​in​ ​which​ ​case​ ​his​ ​lien​ ​is​ ​transferred​ ​to​ ​the​ ​new​ ​post​ ​from​ ​the​ ​date​ ​on​ ​which​ ​he​ ​is​ ​relieved of his duties in the old post;​ 2025.10.27 SHIVAM 16:00:47 ​(d) while on leave; and​ Z00'00' ​(e) while under suspension.​ ​9​ ​(O.A.No. 060/192/2022)​ ​A​​Government​​servant​​on​​acquiring​​a​​lien​​on​​a​​post​​will​​cease​​to​​hold​ ​any lien previously acquired on any other post.​ ​3.3​ ​Retention​ ​of​ ​lien​ ​for​ ​appointment​ ​in​ ​another​ ​central​ ​government office/State Government​ ​(i)​ ​A​ ​permanent​ ​Government​ ​servant​ ​appointed​ ​in​ ​another​ ​Central​ ​Government​ ​Department/Office/State​ ​Government,​ ​has​ ​to​ ​resign​ ​from​ ​his​ ​parent​ ​department​ ​unless​ ​he​ ​reverts​ ​to​ ​that​ ​department​ ​within​ ​a​ ​period​ ​of​ ​2​ ​years,​ ​or​ ​3​ ​years​ ​in​ ​exceptional​ ​cases.​ ​An​ ​undertaking​​to​​abide​​by​​this​​condition​​may​​be​​taken​​from​​him​​at​​the​ ​time of forwarding of his application to other departments/offices.​ ​(ii)​ ​The​ ​exceptional​ ​cases​ ​may​ ​be​ ​when​ ​the​ ​Government​ ​servant​ ​is​ ​not​ ​confirmed​ ​in​​the​​department/office​​where​​he​​has​​joined​​within​​a​ ​period​ ​of​ ​2​ ​years.​ ​In​ ​such​ ​cases​ ​he​ ​may​ ​be​ ​permitted​ ​to​ ​retain​ ​the​ ​lien​ ​in​ ​the​ ​parent​ ​department/​ ​office​ ​for​ ​one​ ​more​ ​year.​ ​While​ ​granting​ ​such​ ​permission,​ ​a​ ​fresh​ ​undertaking​ ​similar​ ​to​ ​the​ ​one​ ​indicated above may be taken from the employee.​ ​(iii)​ ​Timely​ ​action​ ​should​ ​be​ ​taken​ ​to​ ​ensure​ ​extension/​ ​reversion/​ ​resignation​​of​​the​​employees​​to​​their​​parent​​cadres​​on​​completion​​of​ ​the​​prescribed​​period​​of​​2/3​​years.​​In​​cases,​​where​​employees​​do​​not​ ​respond​ ​to​ ​instructions,​ ​suitable​ ​action​ ​should​ ​be​ ​initiated​ ​against​ ​them​​for​​violating​​the​​agreement/​​undertaking​​given​​by​​them​​as​​per​ ​(i)​ ​and​ ​(ii)​ ​above​ ​and​ ​for​ ​termination​ ​of​ ​their​ ​lien.​ ​Adequate​ ​opportunity​ ​may,​ ​however,​ ​be​ ​given​ ​to​ ​the​ ​officer​ ​prior​ ​to​ ​such​ ​consideration.​ ​(iv)​ ​Temporary​ ​Government​ ​servants​ ​will​ ​be​ ​required​ ​to​ ​severe​ ​connections​ ​with​ ​the​ ​Government​ ​in​ ​case​ ​of​ ​their​ ​selection​ ​for​ ​outside posts. No lien will be retained in such cases.​ ​(DOPT O.M.No.8/4/70-Estt(C) dated 06.03.1974)​ ​"Termination of Lien​ ​3.4.1​​A​​Government​​servant's​​lien​​on​​a​​post​​may​​in​​no​​circumstances​ ​be​​terminated​​even​​with​​his​​consent​​if​​the​​result​​will​​be​​to​​leave​​him​ ​without​ ​a​ ​lien​ ​upon​​a​​permanent​​post.​​Unless​​his​​lien​​is​​transferred,​ ​a​ ​Government​ ​servant​ ​holding​ ​substantively​ ​a​ ​permanent​ ​post​ ​retains​ ​lien​ ​on​ ​that​ ​post​​.​ ​It​ ​will​ ​not​ ​be​ ​correct​ ​to​ ​deny​ ​a​ ​Government​ ​servant​ ​lien​ ​to​ ​a​ ​post​ ​he​ ​was​ ​holding​ 2025.10.27 SHIVAM 16:00:47 ​substantively​ ​on​ ​the​ ​plea​ ​that​ ​he​ ​had​ ​not​ ​requested​ ​for​ Z00'00' ​retention​ ​of​ ​lien​ ​while​ ​submitting​ ​his​ ​Technical​ ​Resignation,​ ​10​ ​(O.A.No. 060/192/2022)​ ​or​ ​to​ ​relieve​ ​such​ ​a​ ​Government​ ​servant​ ​with​ ​a​ ​condition​ ​on​ ​that no lien will be retained.​ ​3.4.2​​A​​Government​​employee's​​lien​​on​​a​​post​​shall​​stand​​terminated​ ​on​ ​his​ ​acquiring​ ​a​ ​lien​ ​on​ ​a​ ​permanent​ ​post​ ​(whether​ ​under​ ​the​ ​Central​ ​Government​ ​or​ ​a​ ​State​ ​Government)​ ​outside​ ​the​ ​cadre​ ​on​ ​which he is borne."​ ​3.​​4.3 No lien shall be retained:​ ​a.​ ​where​ ​a​ ​Government​ ​servant​ ​has​ ​proceeded​ ​on​ ​immediate​ ​absorption​​basis​​to​​a​​post​​or​​service​​outside​​his​​service/cadre/post​​in​ ​the Government from the date of absorption; and​ ​b.​ ​on​ ​foreign​ ​service/deputation​ ​beyond​ ​the​ ​maximum​ ​limit​ ​admissible under the orders of the government from time to time."​ ​14.​ ​While​​the​​learned​​Member​​(A)​​arrived​​at​​the​​conclusion​​that​​since​ ​the​​applicant​​nowhere​​asked​​for​​retention​​of​​lien,​​and​​as​​per​​employees​ ​governing​ ​Punjab​ ​Employees,​ ​she​ ​had​​also​​not​​exercised​​the​​option​​for​ ​retention​ ​of​ ​her​ ​lien​ ​within​ ​a​ ​period​ ​of​ ​06​ ​months,​ ​and​ ​therefore​ ​Respondent​ ​No.​ ​1​ ​&​ ​2​ ​rightly​ ​fixed​ ​her​ ​pay​​and​​there​​is​​no​​anomaly​​in​ ​the​ ​their​ ​respective​ ​orders,​ ​the​ ​view​ ​taken​ ​by​ ​learned​ ​Member​ ​(J)​ ​is​ ​that​ ​the​ ​applicant​ ​herein​ ​initially​ ​was​ ​an​ ​employee​ ​of​ ​State​ ​of​ ​Punjab​ ​and​ ​then​ ​she​ ​joined​ ​the​ ​PGIMER,​ ​which​ ​is​ ​governed​ ​by​​OMs​​and​​Rules​ ​issued​​by​​the​​Central​​Government.​​She​​joined​​the​​new​​department​​after​ ​submitting​ ​Technical​ ​resignation​ ​to​ ​her​ ​previous​ ​employer,​ ​therefore,​ ​her​​entitlement​​to​​the​​benefit​​of​​pay​​protection​​cannot​​be​​denied​​as​​per​ ​the​​instructions​​issued​​by​​the​​Government​​of​​India​​adopted​​by​​the​​State​ ​of Punjab vide order dated 19.02.2016 (Annexure A-24 colly).​ ​15.​ ​This​​Tribunal​​has​​considered​​the​​matter​​and​​is​​of​​the​​view​​that​​the​ ​technical​ ​resignation​ ​submitted​ ​by​ ​the​ ​applicant​ ​is​ ​the​ ​only​ ​mandatory​ ​condition,​​as​​provided​​in​​the​​instructions​​aforementioned,​​to​​get​​entitled​ ​for​ ​various​ ​benefits​ ​including​ ​benefit​ ​of​ ​past​ ​service​ ​rendered​ ​in​ ​the​ ​previous​ ​department.​ ​There​ ​is​ ​not​ ​even​ ​a​ ​whisper​ ​of​ ​any​ ​condition​ ​of​ 2025.10.27 SHIVAM 16:00:47 ​retention​ ​of​ ​lien​ ​for​ ​granting​ ​the​ ​benefit​ ​of​ ​past​ ​service.​ ​In​ ​these​ Z00'00' ​instructions,​ ​it​ ​has​ ​also​ ​been​ ​made​ ​clear​ ​that​ ​in​​case​​an​​employee​​has​ ​applied​ ​through​ ​proper​ ​channel​ ​for​ ​a​ ​post​ ​in​ ​the​ ​same​ ​or​ ​other​ ​11​ ​(O.A.No. 060/192/2022)​ ​department,​ ​the​ ​resignation​ ​submitted​ ​shall​ ​be​ ​treated​ ​as​ ​Technical​ ​Resignation​ ​even​ ​if​ ​the​ ​word​ ​'Technical'​ ​is​ ​not​ ​mentioned​ ​in​ ​the​ ​resignation by the employee.​ ​16.​ ​The​​controversy​​in​​hand​​stands​​settled​​in​​view​​of​​the​​provisions​​of​ ​Rule​​3.4.1.,​​which​​specifically​​states​​that​​it​​will​​not​​be​​correct​​to​​deny​​a​ ​Government​ ​servant​ ​lien​ ​to​ ​a​ ​post​ ​he​​was​​holding​​substantively​​on​​the​ ​plea​​that​​he​​had​​not​​requested​​for​​retention​​of​​lien​​while​​submitting​​his​ ​resignation.​​The​​Rule​​also​​gives​​protection​​of​​lien​​to​​the​​employees​​even​ ​in​ ​the​ ​cases​ ​where​ ​the​ ​employer​ ​relieves​ ​him​ ​on​ ​the​ ​condition​ ​that​​no​ ​lien​ ​will​ ​be​ ​retained.​ ​Thus,​ ​the​ ​provisions​ ​aforementioned​ ​leave​ ​no​ ​doubt​ ​that​ ​there​ ​is​ ​no​ ​need​ ​to​ ​give​ ​specifically​ ​an​ ​option​ ​by​ ​a​ ​permanent​ ​employee​ ​to​ ​retain​ ​his​ ​lien​ ​while​ ​submitting​ ​technical​ ​resignation.​ ​17.​ ​In​​the​​present​​case,​​the​​applicant​​was​​a​​regular​​employee​​of​​the​ ​BFUHS,​ ​therefore,​ ​she​ ​acquired​ ​lien,​ ​as​​a​​right,​​on​​the​​permanent​​post​ ​of​ ​Nuclear​ ​Medicine​ ​Physicist​ ​in​ ​BFUHS​ ​and​ ​the​​lien​​so​​acquired​​by​​her​ ​on​ ​the​ ​post​ ​cannot​ ​be​ ​terminated​ ​in​ ​any​ ​circumstances.​ ​The​ ​lien​ ​so​ ​acquired​​will​​cease​​only​​on​​acquiring​​a​​lien​​on​​the​​new​​post​​to​​which​​he​ ​has​​joined​​in​​the​​new​​department​​i.e.​​PGIMER,​​when​​he​​gets​​confirmed​ ​on​​that​​post​​after​​successful​​completion​​of​​probation​​period​​and​​till​​then​ ​she​ ​shall​ ​retain​ ​her​ ​lien​ ​on​ ​his​ ​permanent​ ​post​ ​in​ ​the​​BSFU​​and​​would​ ​be entitled to draw the presumptive pay of the permanent post.​ ​18.​ ​The​ ​respondents​ ​have​ ​relied​ ​upon​ ​Office​ ​Memorandum​ ​dated​ ​05.8.2020​ ​to​ ​deny​ ​pay​ ​protection,​ ​which​ ​provides​ ​that​ ​the​ ​pay​ ​protection​ ​under​ ​FR​ ​22-B​ ​(1)​ ​will​ ​be​ ​available​ ​to​ ​the​ ​government​ ​servant,​ ​if,​ ​he​ ​hold​ ​a​ ​lien​ ​on​ ​his​ ​permanent​ ​post.​ ​In​ ​my​ ​view,​ ​the​ ​instructions​ ​vide​ ​O.M.​ ​dated​​05.08.2020​​(Annexure​​A-26)​​would​​not​​be​ 2025.10.27 SHIVAM 16:00:47 ​applicable​ ​in​ ​the​ ​case​ ​of​ ​applicant​ ​as​ ​she​ ​joined​ ​new​ ​service​ ​with​ ​the​ Z00'00' ​PGIMER​ ​under​ ​Central​ ​Government​ ​after​ ​resigning​​from​​the​​post​​under​ ​respondent​ ​no.​ ​3​ ​with​ ​the​ ​State​ ​of​ ​Punjab.​ ​From​ ​the​ ​reading​ ​of​ ​O.M.​ ​12​ ​(O.A.No. 060/192/2022)​ ​dated​ ​05.08.2020,​ ​it​ ​is​ ​evident​ ​that​ ​these​ ​instructions​ ​would​ ​be​ ​applicable​ ​where​ ​a​ ​central​ ​Government​ ​employee,​ ​who​ ​after​ ​technical​ ​resignation,​​is​​appointed​​to​​new​​post​​in​​the​​different​​service​​or​​cadre​​in​ ​central​​Government​​through​​direct​​recruitment.​ ​From​​the​​reading​​of​​the​ ​subject​ ​of​ ​the​ ​said​ ​O.M.,​ ​it​ ​is​ ​crystal​ ​clear​ ​that​ ​protection​ ​of​ ​pay​ ​is​ ​granted​ ​to​​the​​Central​​Government​​Servant​​consequent​​to​​appointment​ ​to​ ​a​ ​new​ ​post​ ​in​ ​different​ ​service​ ​or​ ​cadre​ ​in​ ​Central​ ​Government,​ ​through​ ​direct​ ​recruitment​ ​where​ ​either​ ​higher​ ​duties​ ​and​ ​responsibilities​ ​are​ ​involved​ ​or​​not,​​as​​the​​case​​may​​be,​​under​​FR-22-B​ ​(1),​ ​in​ ​the​ ​7​t​h​ ​CPC.​ ​The​ ​facts​ ​of​ ​the​ ​case​ ​in​ ​hand​ ​are​ ​different​ ​as​ ​the​ ​applicant​ ​has​ ​technically​ ​resigned​ ​from​ ​the​ ​service​ ​under​ ​State​ ​of​ ​Punjab to join the PGIMER, Chandigarh under Central Government.​ ​19.​ ​The​ ​reliance​ ​placed​ ​by​ ​respondent​ ​no.​ ​3​ ​on​ ​clause​ ​3.12​ ​of​ ​PCS​ ​Rules,​ ​Volume-I​ ​read​ ​with​ ​instructions​ ​dated​ ​19.02.2016,​ ​in​​support​​of​ ​their​​averment​​that​​the​​applicant​​requires​​to​​give​​option​​to​​retain​​lien,​​is​ ​misconceived.​ ​The​ ​Rule​ ​3.12​ ​provides​ ​that​ ​the​ ​employee​ ​concerned,​ ​after​​completion​​of​​probation​​period,​​shall​​give​​an​​option​​to​​acquire​​lien​ ​on​ ​the​ ​new​ ​post​ ​and​ ​on​ ​acquiring​ ​lien​ ​on​ ​that​ ​post,​ ​he​ ​shall​ ​cease​ ​to​ ​hold​ ​lien​ ​on​ ​the​ ​post​ ​in​ ​the​ ​parent​ ​cadre​ ​i.e.​ ​previous​ ​department.​ ​It​ ​nowhere​ ​mentions​ ​that​ ​the​ ​employee​ ​has​ ​to​ ​request​ ​for​ ​retaining​ ​his​ ​lien​ ​which​​he​​acquired,​​as​​a​​right,​​on​​the​​permanent​​post​​in​​the​​parent​ ​department.​ ​In​ ​my​ ​opinion,​ ​the​ ​respondents​ ​have​ ​misinterpreted​ ​the​ ​provisions​ ​of​ ​clause​ ​3.12​ ​while​ ​stating​ ​that​ ​applicant's​ ​lien​ ​on​​the​​post​ ​held​ ​by​ ​him​ ​has​ ​not​ ​been​ ​retained​ ​in​ ​the​ ​absence​ ​of​ ​any​ ​request​ ​by​ ​him.​ ​20.​ ​In​ ​light​ ​of​ ​the​ ​discussion​ ​hereinabove,​ ​I​ ​concur​ ​with​ ​the​ ​view​ ​taken​ ​by​ ​Member​ ​(J)​ ​and​ ​conclude​ ​that​ ​since​ ​the​ ​applicant​ ​applied​ ​for​ 2025.10.27 SHIVAM 16:00:47 ​the​ ​post​ ​of​ ​Nuclear​ ​Medicine​ ​Physicist​ ​in​ ​PGIMER,​ ​Chandigarh​ ​through​ Z00'00' ​proper​​channel​​and​​submitted​​technical​​resignation​​to​​the​​BFUHS​​before​ ​joining​ ​the​ ​new​ ​post​ ​in​ ​PGIMER,​ ​therefore,​ ​she​ ​retains​ ​13​ ​(O.A.No. 060/192/2022)​ ​her​ ​lien​ ​on​ ​the​ ​post​ ​held​ ​by​ ​her​ ​in​ ​BFUHS​ ​and​ ​she​ ​is​ ​entitled​ ​to​ ​the​ ​benefit​ ​of​ ​pay​ ​protection,​ ​as​ ​discussed​ ​hereinabove,​ ​consequent​ ​to​ ​appointment​ ​to​ ​a​ ​new​ ​post​ ​in​ ​PGIMER,​ ​Chandigarh.​ ​The​ ​impugned​ ​orders​​dated​​18.11.2011,​​15.12.2011​​and​​10.02.2022​​are​​quashed​​and​ ​set​​aside​​being​​not​​in​​consonance​​with​​the​​Rules​​to​​the​​extent​​it​​stated​ ​that​ ​the​ ​applicant's​ ​lien​ ​was​ ​not​ ​retained​ ​since​ ​she​ ​did​ ​not​ ​give​ ​such​ ​option​ ​and​ ​thus​ ​she​ ​is​ ​disentitled​ ​for​ ​pay​ ​protection​ ​in​ ​the​ ​new​ ​department.​​The​​Original​​Application​​is​​allowed​​and​​the​​applicant​​is​​held​ ​entitled​​to​​the​​benefit​​of​​pay​​protection​​as​​per​​instructions​​in​​O.M.​​dated​ ​17.08.2016.​ ​The​ ​respondent​​no.​​1​​and​​2​​are​​directed​​to​​do​​the​​needful​ ​within​​a​​period​​of​​two​​months​​from​​the​​date​​of​​receipt​​of​​a​​copy​​of​​this​ ​order.
