7 11-12-2013One of the contentions raised on behalf of the Appellants is that candidates who had appeared in the Civil Engineering paper have not been declared as pass on basis of aggregate marks obtained in their own paper, General Knowledge and Interview combine on the ground that they had failed to secure qualifying marks in the Civil Engineering paper. But some of the candidates who appeared for the Mechanical Engineering examination under the same Advertisement No. 1906/06 dated 29.11.2006 have been declared pass on basis of aggregate marks even though they had failed to secure qualifying marks in the individual papers. The submission therefore is of arbitrariness and hostile discrimination.
Our attention in this regard has been drawn to Paragraph-16 of the writ application also.
Counsel for the respondents fairly submits that this issue is required to be answered on affidavit.
