                               JUDGMENT

The petitioner's request for renewal of explosives licence has been rejected citing involvement in a crime. It appears from Ext.P9 is that a crime is registered against the petitioner by the Nileswar Police Station under Section 286 of the Indian Penal Code and Section 9 B (1)(b) of the Explosives Act. This case is pending before the Judicial First Class Magistrate Court-II, Hosdurg.

2. This Court is of the view that in the light of Rule 118 (1)(b) of the Explosive Rules, the request for renewal can be rejected only on the ground that the petitioner has been convicted in a criminal offence.

In that view of the matter, the petitioner's application for renewal shall be taken up and considered and shall be granted within a period of three weeks from the date of receipt of a copy of this judgment, if the petitioner is otherwise eligible. However, if the petitioner is ultimately convicted for the criminal offence, the respondents are free to proceed against the petitioner in accordance with law.

The writ petition is disposed of as above.
