Section 5(4) in The Intellectual Property Appellate Board (Patents Procedure) Rules, 2010
(4)Every appeal or application, if filed by a person other than the appellant or applicant, then an affidavit stating the competency of the person shall be filed along with such appeal or application and the affidavit shall state the name and address and sufficiently describe the identity of the deponent and shall also state in what capacity he is so doing and whether he is authorised and if so by whom and by what instrument and a copy thereof shall be annexed to the affidavit.
