ORAL ORDER:

Heard Mr. C.Raja Shekar Reddy, learned counsel for the petitioner and learned Government Pleader for Services - II appearing on behalf of the respondents.

2. The present Writ Petition is filed to declare the action of the respondents in not considering the case of the petitioner for allocation to the proper District/Zone as per the seniority as fixed by the respondents in their cadres as per G.,O.Ms.No.317, G.A. (SPF-1) Department dated 06.12.2021, as illegal and arbitrary and for a consequential direction to the respondents to consider the case of the petitioner by following the seniority as fixed by the respondent in their respective cadres and effect the transfers in allocating the Distrcits/Zone/Multizone in their cadre.

3. Perusal of the record would reveal that vide proceedings dated 11.01.2022, respondent No.3 has allotted the petitioner herein to PHC Shivampet, Medak District. Thereafter, the petitioner herein had submitted an application dated 11.01.2022 to the 2nd respondent 2 requesting him to cancel her posting to Zone-III and allot her to Zone- IV. Despite receiving and acknowledging the said application, respondent No.2 did not act upon it. Therefore, the present writ petition.

4. On the other hand, learned Government Pleader for Services

- II, would submit that respondent No.2 will consider the application submitted by the petitioner herein and pass appropriate orders in accordance with law.

It is relevant to note that as per Clause 27 of G.O.Ms.No.317, dated 06.12.2021 any employee aggrieved by an allotment to a local cadre may submit a representation to the Secretary to the Government of the concerned Department. The Government may, on receipt of such representation, duly consider and dispose of the same as deemed fit.

In view of the above said submission, this Writ Petition is disposed of directing respondent No.2 to consider the application submitted by the petitioner herein dated 11.01.2022 and pass appropriate orders in accordance with law. Respondent No.2 shall 3 complete the entire exercise within a period of four (04) weeks from today, and communicate copy of the order to the petitioner herein.

As a sequel, the miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
