Section 31 in The Bihar Juvenile Justice (Care and Protection of Children) Rules, 2003
31. Shelter Homes.
(1)For the children in urgent need of care and protection, such as destitutes, street children and run-away children, the State Government shall support creation of the requisite number of shelter homes or drop-in-centres through the voluntary organizations.(2)The shelter homes or drop-in-centres shall have the minimum facilities of boarding and lodging, besides the provision for fulfilment of basic needs in terms of clothing, food, health care and nutrition.(3)Such children in crisis situations may live in short-stay homes which may have the requisite facilities for eduction, vocational training and recreation as well.(4)The Committee, Special Juvenile Police Units, public servants, Childlines, voluntary organizations, social workers and the children themselves may refer a child to such shelter homes.(5)The requirements of investigation and disposal shall not apply in cases of children residing in the shelter home, except giving information to the Committee and the police about the missing or homeless children, besides initiating legal action in the interest of the child in terms of the Act or other child related laws.(6)The services of Officer-in-Charge, child welfare officer, social worker shall be provided for the proper care, protection, development, rehabilitation and reintegration needs of such children.(7)No child shall ordinarily stay in the Government funded shelter home or drop-in-centre for more than a year.
