1. The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.0077/2019 registered at Police Station Shri Madhopur, District Sikar for the offence(s) under Sections 354, 363, 376, 511 of IPC and Section 7, 8 of Protection of Child from Sexual Offences Act (in F.I.R.) & under Sections 363, 366, 376 (AB)/511, 354 of IPC and Section 9(M)/10 of POCSO Act.
2. Counsel for the petitioner submits that the petitioner has been falsely implicated in this matter. Counsel further submits that F.I.R. has been lodged after a delay of ten days. Counsel further submits that allegation against the petitioner is that he tried to outrage the modesty of the victim. Counsel further submits that the petitioner is in custody since 07.03.2019.

4. Considering the material on record and taking into account the facts and circumstances of the case and considering the statement of victim (PW-1) and her father (PW-2) and also considering the period of custody and without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to regular bail subject to satisfaction of the trial Court. Office is directed to send a copy of this order to the concerned trial Court through e-mail/fax, for necessary compliance.
