ORDER (ORAL)
Hon'ble Mr. Manish Garg, Member (J) In the present Original Application filed under Section 19 of the Administrative Tribunals Act, 1985, the applicant seeks the following reliefs:-
"(i) That the Hon'ble Tribunal may graciously be pleased to pass an order of quashing the impugned order dated 26.10.2015 and order and order dated 7.7.2017 (Annex.
A/1&A/2), order dated 20.12.2023 (Annex.A/3), order datd 27.12.2023 (Annex.A/4), and orders dated 11.12.2024 (Annex.A/5) (colly.), declaring to the effect that the whole action of the respondents reducing transport allowances of the applicants and recovering the earlier granted transport allowances at Delhi Rates is illegal, arbitrary and against the law of the land and consequently, pass an order directing the respondents to restore the transport allowances at Delhi rate to the staff working in K.V. Noida at with K.V. Ghaziabad sand refund the same if any recovered with interest.
(ii) Any other relief which the Hon'ble Tribunal deem fit and proper may also be granted to the applicant with the costs of litigation."

Learned counsel for the applicant submits that the applicant is presently working in Kendriya Vidyalaya, Sector-24, Noida and during the course of his service the applicant had been granted transport allowance at the rates applicable to Delhi. 2.1 Learned counsel for the applicant submits that the transport allowance had been paid to the applicant by the department itself over a long period 2026.03.17 SNEHA 14:38:52+ MEENA 05'30' 24 Item No.113/ C-IV O.A. No.243/2025 of time and the applicant had been drawing the same in the normal course of service.
2.2 Learned counsel further submits that the controversy arose when the Regional Office, Agra issued directions dated 20.12.2023 directing regulation of transport allowance in Kendriya Vidyalaya Noida at the rates applicable to "other cities". In compliance thereof, the Principal, K.V. Noida issued an order dated 27.12.2023 directing that transport allowance be regulated at the lower rates and also proposing recovery of the earlier payments. 2.3 It is submitted that several employees, including the applicant, submitted representations against the said action on 06.03.2024 through proper channel, which were forwarded to the competent authority. The said order was kept in abeyance pending decision on the representations.
2.4 Learned counsel submits that thereafter the respondents, vide impugned order dated 11.12.2024, rejected the request of the applicants and decided not only to reduce the transport allowance but also to effect recovery of the amount already paid, which has 2026.03.17 SNEHA 14:38:52+ MEENA 05'30' 25 Item No.113/ C-IV O.A. No.243/2025 been directed to be recovered from the salary of January 2025 onwards.
2.5 Learned counsel for the applicant submits that no show cause notice was issued to the applicant before initiating the recovery proceedings. The action of the respondents in ordering recovery without affording an opportunity to the applicant is therefore contrary to the principles of natural justice. 2.6 Learned counsel for the applicant submits that the applicant is not pressing for parity of rates or restoration of transport allowance at par with employees posted at KVS Ghaziabad or Delhi. The applicant confines his grievance only to the recovery being effected from his salary in respect of the transport allowance already paid. 2.7 Learned counsel submits that the payment in question had been made by the department itself and the applicant had not misrepresented any fact. Therefore, the recovery sought to be effected at this stage is arbitrary and unjustified. 2.8 Learned counsel for the applicant, therefore, submits that the recovery proceedings deserve to be 2026.03.17 SNEHA 14:38:52+ MEENA 05'30' 26 Item No.113/ C-IV O.A. No.243/2025 set aside and the respondents be directed not to recover the amount already paid to the applicant.

Per contra, learned counsel appearing for the respondents strongly opposes the relief sought by the applicants and reiterates the averments made in the counter reply filed on behalf of the respondents. 3.1 Learned counsel submits at the outset that the present Original Application is devoid of merit and deserves to be dismissed as the impugned action of the respondents has been taken strictly in accordance with the applicable rules and government instructions. It is further submitted that the applicants have not approached this Tribunal with clean hands and have suppressed certain material facts relevant for adjudication of the present dispute. 3.2 Learned counsel for the respondents submits that it is a matter of record that, as per the O.M. No. 21(8)2010-E-II(B) dated 01.08.2012 issued by the Department of Expenditure, Ministry of Finance, Government of India on 'Payment of Transport Allowance to Central Government Employees in Faridabad, Gurgaon, Ghaziabad and Noida', the 2026.03.17 SNEHA 14:38:52+ MEENA 05'30' 27 Item No.113/ C-IV O.A. No.243/2025 entitlement of transport allowance has been clarified. The operative part of the said O.M. reads as under:-
"It is clarified that the Central Government Employees posted at Faridabad, Gurgaon, Ghaziabad and Noida are entitled to Transport Allowance at the rates applicable to 'other places i.e. other than 73 classified cities as per the conditions laid down in this Ministry's O.M. No. 21 (2)/2008-E-II(B) dated 29.08.2008."
3.3 Learned counsel for the respondents further submits that, as per the O.M. No. 21(8)/2010-E-II(B) dated 07.03.2014 issued by the Department of Expenditure, Ministry of Finance, Government of India on 'Payment of Transport Allowance to Central Government Employees posted in offices located at Faridabad, Gurgaon, Ghaziabad and Noida - Order of the Hon'ble Central Administrative Tribunal, Principal Bench, New Delhi in O.A. No. 2080/2012, ML Rustagi vs. Union of India & Others and 22 OAs (clubbed together) - matter regarding', the issue of admissibility of Transport Allowance has been clarified. The operative part of the said O.M. reads as under:-
"2(f) The 6th CPC while recommending CAA to be subsumed in Transport Allowance, did not recommend any special dispensation to be given to any locality in the matter of grant of Transport Allowance. Orders on implementation of the recommendations of 6th CPC were issued vide Ministry of Finance OM No. 21 (8)2010-E-II(B) dated 29.08.2008 (effective from 01.09.2008) wherein higher rates of Transport Allowance were allowed to 'A- 1/A' class cities and lower rates to 'Other Places'. The names of those 13 cities, to which higher rates of Transport Allowance is admissible, have been explicitly 2026.03.17 SNEHA 14:38:52+ MEENA 05'30' 28 Item No.113/ C-IV O.A. No.243/2025 mentioned therein, which do not include Faridabad, Ghaziabad, Gurgaon or Noida. All cities/towns/places other than those 13 admissibility of Transport Allowance. Moreover, Delhi (UA) classified as 'A-1' class city for CCA purpose does not includes the areas of Faridabad, Ghaziabad, Gurgaon and Noida.
3. Therefore, Transport Allowance to Central Government Employees posted in offices located at Faridabad, Gurgaon, Ghaizaibad and Noida should be regulated as per the rates applicable to 'Other Places' in terms of Ministry of Finance O.M. No. 21 (2)/2008-E.II (B) dated 29.8.2008."
3..4 Learned counsel submits that in terms of the aforesaid policy instructions, the applicant was not entitled to the allowance in question and therefore the department was justified in initiating recovery of the excess payment.
3.5 It is further submitted that the interim protection granted earlier by this Tribunal was based upon certain premises and the same cannot continue indefinitely.

We have heard learned counsel for the parties and perused the material placed on record. 4.1 From the submissions advanced by learned counsel for the applicant, it is clear that the applicant has confined his relief only to the recovery being effected by the respondents. The applicant is not pressing for grant of transport allowance at par with 2026.03.17 SNEHA 14:38:52+ MEENA 05'30' 29 Item No.113/ C-IV O.A. No.243/2025 employees posted at other stations such as Ghaziabad or Delhi.
4.2 Thus, the limited issue that arises for consideration in the present case is whether the respondents could have ordered recovery of the amount already paid to the applicant without issuing a show cause notice and without granting an opportunity of hearing.
4.3 It is an admitted position that the transport allowance had been paid to the applicant by the department itself over a period of time. The applicant had not sought the payment by any misrepresentation.
4.4 The respondents have not placed any material on record to show that any show cause notice was issued to the applicant prior to ordering recovery. 4.5 Learned counsel for the applicants relies upon the decision rendered in O.A. No. 2265/2019 along with O.A. No. 2477/2019, decided on 09.04.2024, and submits that in terms of the said decision the applicants seek extension of the protection granted to the applicants in O.A. No. 4663/2015, who are 2026.03.17 SNEHA 14:38:52+ MEENA 05'30' 30 Item No.113/ C-IV O.A. No.243/2025 presently agitating their claim before the Hon'ble High Court in W.P.(C) No. 8346/2021. It is not disputed that the present applicants are similarly placed to the applicants in W.P.(C) No. 8346/2021. The relevant para of the said order reads as under:-
"11. Accordingly, the order dated 18.07.2019 whereby recovery has been effected is being stayed to await the outcome of the W.P.(C) No.8346/2021, which is pending consideration before the Hon'ble High court Of Delhi. Further, it is made clear that the applicants being similarly placed to the applicants in the W.P.(C) No.8346/2021, their fate shall also be subject to the outcome of the decision in the said W.P.(C). Both the parties shall be bound by the decision of the Hon'ble High Court as and when the same is decided. Both the O.A.s are disposed in the above terms. No orders as to costs."
5. In view of the above, the present O.A. is disposed of in terms of the aforesaid quoted paragraph 11 of the order passed in O.A. No. 2265/2019 along with O.A. No. 2477/2019.
6. All pending Miscellaneous Applications, if any, shall also stand disposed of.
7. There shall be no order as to costs.
