Bengal Presidency - Section

Section 448 in Police Regulations, Bengal , 1943

448. Court officers's responsibility in connection with records. [§12, Act V, 1861].

- As soon as the police papers of a case are laid on the trying Magistrate's table the Court officer's responsibility with regard to them ceases. Before the papers are put in, the Court officer should take care to make copies, whenever necessary, of such papers as are likely to be filed with the judicial proceedings. He has no concern with the custody of the judicial records of cases or with the Record office. He shall not retain in his possession the records of a case under trial unless otherwise ordered in writing by the trying Magistrate. If he subsequently requires a copy of any portion of the records he should make an application to the trying Magistrate for permission to take the copy in the presence of a responsible official of the Court.
