Facts:
1. Appellant submitted RTI application dated 10 December 2010 before the CPIO, NIA Co., Patna seeking the details about the issuing of the Motor Insurance Cover note no. Pat/9394/5705.
2. Vide CPIO Order dated 18 January 2011, CPIO provided information to the Appellant.
3. Not satisfied by the CPIO's Reply, the Appellant preferred first Appeal to the First Appellate Authority dated 1 February 2011.
4. Vide FAA Order dated 7 February 2011, the FAA upheld the CPIO's Order.
5. Being aggrieved and not being satisfied by the above response of the public authority, the appellant preferred second appeal before the Commission.
6. Matter was heard today via videoconferencing from Patna where the respondent as above were present. Appellant was heard from Palamu. Appellant clarified that the information sought pertained to the years 1994 and 1999. Respondent reiterated that as per their prescribed schedule, the requested information was required to be retained only for threeyear period and had since been destroyed. However first appellate authority stated that she was making further efforts to locate Appeal: No. CIC/DS/A/2011/002010 any related files in which this information may be available at her branch office at Daltonganj, and Divisional offices at Patna and Ranchi.
Decision notice After hearing both parties, Commission is satisfied that information as currently held by the CPIO has already been provided to the appellant. However a period of three weeks is given to the respondent for the special effort being put in at the instance of the first appellate authority in trying to locate the requested information from other offices. Respondent will also provide to the appellant, a copy of the prescribed schedule under which the requested records have been destroyed.
