1. This application, moved by the defendant, seeks permission to sell existing stocks of the product manufactured by the defendant. During the course of arguments, Mr. Jayant Kumar, learned Counsel for the defendant, on instructions, submitted that his client is willing to suffer a decree if the plaintiff is agreeable to forego damages and costs.
2. Ms. Mamta Rani Jha, learned Counsel for the plaintiff, on instructions, agrees that her client would forego the claim for damages and costs and is agreeable to a decree being passed.
3. At this stage, Ms. Jha requests that this matter may be re- notified for tomorrow, i.e. on 24th February 2023 so that terms of settlement could be drafted.
