Bench: Sheo Kumar Singh, Rajesh Chandra

Court No. - 36

Case :- WRIT - C No. - 37029 of 2010

Petitioner :- Chandrashekhar Singh
Respondent :- Union Bank Of India Thr A.G.M. And Anr.
Petitioner Counsel :- Saroj Yadav
Respondent Counsel :- Anamika Singh

Hon'ble Sheo Kumar Singh,J.

Hon'ble Rajesh Chandra,J.

The prayer has been made in this writ petition that the respondents may be directed to issue "no dues certificate" to the petitioner, as the entire amount due against him has already been deposited by the petitioner.

The learned counsel for the respondent stated that the interest part was not included in the citation and huge amount is in balance against the petitioner with regard to the interest.

We are of the considered opinion that the grievance can be properly attended to by the respondent, hence, the petitioner is directed to make a representation to the respondent no. 1 raising all his grievances. The petitioner shall then be provided with the details of the deposits and balances, so that the petitioner may know as to how much amount has to be deposited by him. The representation shall be made within two weeks from today with a copy of this order and after the representation is made, same shall be decided by respondent no. 1, preferrably within a period of four weeks. After the balance is cleared, the respondents shall issue no dues certificate to the petitioner.

Writ petition stands disposed of.
