PRAYER: The Writ Petition is filed under Article 226 of the Constitution of
India for the issuance of a Writ of Mandamus directing the respondent Nos. 1
and 2 to defreeze the petitioner's Bank Account at HDFC Bank, Kalapatti Main
Road Branch, 5A, Nr Suguna Auditorium, Nehru Nagar West, Coimbatore,
Tamil Nadu bearing bank account No.10681130001655 with the third
respondent and the petitioner's another Credit Card Account at Standard
Chartered Bank, Rajaji Salai Branch, Chennnai – 600 001 bearing bank account
No.4622715390490244 with the 4th respondent in connection with the Crime
No.30/2024 on the file of the 2nd respondent and permit the petitioner to operate
the said accounts.

ORDER
This Writ Petition has been filed for a direction directing the respondents 1 and 2 to defreeze the petitioner's Bank Account Page 2 of 6 https://www.mhc.tn.gov.in/judis ( Uploaded on: 27/05/2025 03:11:25 pm ) W.P. No. 9556 of 2024 No.10681130001655 with the third respondent and the petitioner's another Credit Card Account with the 4th respondent in connection with the Crime No.30 of 2024 on the file of the 2nd respondent and permit the petitioner to operate the said accounts.
2. In pursuant to the registration of FIR in Crime No.30 of 2024 on the file of the second respondent, the second respondent made a request to the third respondent to freeze the account of the petitioner.
3. Learned counsel for the petitioner would submit that his salary and credit card accounts were frozen by the second respondent. Even according to the second respondent, a sum of Rs.10,000/- was deposited into the petitioner's account. That apart, the petitioner had decided to sell his crypto currency to the tune of 2737.05 USD assessed for the period from 27.12.2024 to 01.03.2024, after following the procedure, the petitioner downloaded the Binance App Store on 02.01.2024 and he identified the seller who is specialized in the lawful selling of USDT-Coin/Crypto currency. After verification, it was valued to the tune of Rs.1,18,717/-. The petitioner accepted and transferred the same in favour of the seller.

No. 9556 of 2024 according to the second respondent, only a sum of Rs.10,000/- was transferred to the petitioner's account. The amount that was remaining in the petitioner's bank account at the time of freezing was only Rs.2,000/- & odd.
5. Now the learned counsel for the third respondent would submit that more than Rs.1 lakh amount is available in the petitioner's bank account.
6. In view of the above, the third respondent is directed to hold a sum Rs.10,000/- and the petitioner is permitted to operate his account by keeping a sum of Rs.10,000/- with the third respondent bank.
7. With the above direction, this Writ Petition is disposed of.
Consequently, connected miscellaneous petition is closed. No costs.
