The prayer of the petitioner is for a direction to the National Council for Technical Education (for short "the Council") to grant recognition to the petitioner-institute for B.A.B.Ed and B.Sc.B.Ed four year integrated course for the academic year 2016-
17. Direction has also been sought to Maharishi Dayanand University (for short "the University") to issue no objection certificate.
On 19.02.2016 Dr. S.K. Chauhan, Regional Director, of the Council and Sh. Vijai Vardhan, Addl. Chief Secretary to Government of Haryana, Department of Higher Education were present in Court. It transpired that there was lack of coordination between the three bodies namely, the State, affiliating University and PUSHPA ADHIKARI 2016.02.25 17:48 I attest to the accuracy and integrity of this document 2 CWP No. 25532 of 2015 the Council, as a result of which the number of colleges imparting B.Ed. education mushroomed in the State. Intake capacity was 60,672 students for the session 2015-2016 whereas only 32,811 seats could be filled up despite granting four weeks extra time for counselling after the last cut off date.
Learned counsel for the petitioner submitted that the petitioner is ready to forgo its already sanctioned seats of B.Ed., in case it is granted approval for integrated course of B.A.B.Ed. and B.Sc.B.Ed. He further submitted that let the matter be re-examined by the University and thereafter by the Council in terms of the stand of the State as to whether new capacity for imparting B.Ed. education is to be added in the State or not.
Learned counsel for the University pointed out that at the time of inspection, the college was not found to be having infrastructure and the teaching faculty even for the existing sanctioned courses of B.Ed. and M.Ed. To this the stand of learned counsel for the petitioner was that the faculty has been appointed thereafter and the University can inspect the college at any time.
Learned counsel for the State submitted that the State is not in favour of permitting any new seats either for B.Ed. or integrated course of B.A.B.Ed or B.Sc.B.Ed.
Considering the submissions made by learned counsel for the parties, the present petition is disposed of. The University may inspect the college of the petitioner and examine the claim made by it for conversion of its sanctioned seats of B.Ed course to the integrated B.A.B.Ed. or B.Sc.B.Ed course, in the light of the instructions issued by the Government and the Council. Let the needful be done within one week. The petitioner shall be at liberty to avail of its remedy against any decision taken by the University.
The petition stands disposed of.
