The writ petitioner is aggrieved that Shyampukur Police Station has not registered FIR despite a complaint dated 27.01.2023 of intimidation and threat by the private respondents/sons and their wives.

It is alleged that two rooms inside the house have been forcibly locked up and the petitioner has been confined to one room.

Shyampukur Police submits that two sons and daughter-in-law stay elsewhere.

Counsel for the private respondents submits that his clients are inclined to develop the property and have entered into agreement with the promoter. They are shareholders of the property.

The petitioner and her elder daughter are also shareholders of the property. They are not interested in the development of the property as of now. The private respondents cannot force the petitioner and her elder daughter to agree to development of the property.

This Court notices that there is congnizable offence disclosed in the petitioner's complaint dated 27.01.2023. Shyampukur Police Station shall forthwith register FIR.

Counsel for the private respondents submits that his clients are still in the said premises.

The O. C., Shyampukur Police Station shall ensure that two sons and their families do not disturb the petitioner in any way. Regular vigil shall be maintained by the Shyampukur Police. Surprise visits shall also be conducted.

The private respondents, who are represented before this Court, are warned against any kind of violence, intimidation or threat to the petitioner. In the event of any further complaint from the petitioner, appropriate enquiries shall be made and if necessary, coercive steps shall be taken against the private respondents by the Shyampukur Police.

The report of the O. C., Shyampukur Police Station dated 13.02.2023 is taken on record.

In view of the above, the writ petition is disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
