                                       ORDER

1. The Appellant filed an RTI application dated 04.10.2023 seeking information as under:

"My name is Mariya Parween and Enrolment No: 260190213007. I appeared on- demand examination held on June 21, 2023, and got 20 marks in theory. I am not satisfied with my marks and want to review the checked answer sheet copy as per RTI rules."

2. The CPIO replied vide letter dated 02.11.2023 and the same is reproduced as under:-

"As per NIOS norms, Ms. Mariya Parween, Please submit Rs. 750/- per Answer script(book) for issue of photocopy of Answer Scripts. Amount will be paid through Demand Draft in favour of Secretary NIOS, payable at Ranchi."

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated Nil. FAA's order, if any, is not available on record.

4. Aggrieved with the non-receipt of FAA's order, the Appellant approached the Commission with the instant Second Appeal dated Nil stating as under:

"I am not satisfied with my marks and want to review the checked answer sheet copy as per RTI rules. But NIOS demanding an unreasonable amount of Rs. 750/- for approximately 20 pages of the answer sheet. As per RTI norms, required Rs. 2/- per page. Then applied to the First appeal officer and NIOS directing the inside office to provide, but not been received yet."

5. The Appellant remained absent during the hearing and on behalf of the Respondent, Rajendra Prasad, AD & CPIO attended the hearing through video conference.

6. The Commission took on record an intimation of the Appellant sent via email to the Respondent on 07.05.2025 stating that she has received the answer script under RTI and does not wish to pursue the instant matter.

7. The Respondent submitted that the answer script of the Appellant was provided to her eventually on 24.03.2024.

8. The Commission after adverting to the facts and circumstances of the case, and perusal of records, observes that the CPIO in not having asked for additional fee as per the stipulations prescribed under RTI Rules, 2012 has violated the provisions of the RTI Act and recurrence of similar lapses in the future will not be viewed liberally. In the instant case, since the Appellant has not pressed for any action and has also not availed of the opportunity to plead her case, the Commission closes the case with a strict warning to the CPIO to ensure due compliance with the provisions of the RTI Act and RTI Rules in the future.

9. The Appeal is disposed of accordingly.

Copy of the decision be provided free of cost to the parties.
