Section 101(1)(i) in The Bihar Panchayat Raj Act, 2006

(i)if a party doers not nominate a Panch within such time as may be prescribed, the Sarpanch, or in the case of his non-availability, the Up-Sarpanch shall nominate Panch from amongst the Panches of the Gram Katchahry;
