Information sought:
The Appellant filed an online RTI application dated 24.07.2019 seeking the following information related to SSC CGL TIER-I 2018 regarding wrong answer keys provided in the Tentative Answer Keys:
"The three wrong answer keys provided are as follows:-
1) Q89- a fictitious name used by a author Answer given in tentative answer key: ALIBI Correct answer: Pseudonym
2) Q79- Arrogance antonym Answer given in tentative answer key: Sweetness Correct answer: Humility
3) Q21- 24/8-5... interchange the signs There are 2 RIGHT ANSWERS for this question. Answer key 1 and 2. However only answer key 2 is considered here. Both should be considered as the answer key.
Queries:-
A) How to get these answers corrected B) Despite send various emails to concerned dept, there is no reply from the same, do any of the officials actually these emails."
The CPIO replied to the appellant on 29.07.2019 stating as under:
"Reply:- Appellant's application on the wrong question/answer keys is noted. However, the Commission has put in place a mechanism for challenging tentative answer keys of objective type questions, before evaluation. The last date for submitting representations against tentative answer keys is already over. The examination of representation is under process."
Being dissatisfied, the appellant filed a First Appeal dated 29.07.2019. FAA's order dated 08.08.2019 stated as under:
"Reply:- "..... The said Questions IDs:-98958012736, 98958012740(viz. Paper English Language and Comprehension) & 98958013840 (General intelligence & Reasoning) were represented by various Candidates and was thereafter verified by the Subject Experts and the Commission who had recommended retain the tentative answer key in r/o Q.Ids-98958012736, 98958012740 and for QID 98958013840, the Subject Experts had recommended benefit to all which is agreed by the Commission.2
Accordingly, the Commission decided to give benefit to all for QID 98958013840, and the tentative answer key was retained in case of QID 98958012736, 98958012740."
Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.
Relevant Facts emerging during Hearing:
The following were present:-
Appellant: Present through audio conference. Respondent: Monika Rai, US & CPIO present through audio conference.
The CPIO submitted that an appropriate reply has been provided to the Appellant along with adequate clarification regarding his apprehensions about the averred answer key.
The Appellant stated that he does not wish to pursue the instant Appeal.
Decision The Commission based on a perusal of the facts on record observes that the issues raised by the Appellant in his Second Appeal primarily question the merits of the averred answer key, however, adjudication on the said aspect is outside the purview of the RTI Act. Nonetheless, the reply of the CPIO adequately suffices the queries raised in the RTI Application even as the information sought for therein does not conform to Section 2(f) of the RTI Act.
In view of the foregoing and considering the statement of the Appellant, the Commission closes the case.
The appeal is disposed of accordingly.
