2/17.02.2014Heard learned counsel for the parties.
The husband of the petitioner no.1 is said to have died in harness on 28th February, 2012, while serving as 'Peon' in Health Department under the RespondentsMineral Area Development Authority, Dhanbad. The petitioner no.2 is the son of the deceased employee, who has also made a claim for compassionate appointment in place of his deceased father. According to the petitioner, the deathcumretirement dues and other service dues of her deceased husband have not yet been paid to her. Learned counsel for the petitioner submits that the petitioner has preferred several representations such as Annexures1 & 2 Series in respect of claim for deathcumretirement dues and Annexure 3 to 6 in respect of claim of petitioner no. 2 for considering his case for compassionate appointment before the competent authority of M.A.D.A., but the aforesaid grievances have not yet been redressed.
Learned counsel for the RespondentsM.A.D.A submits that if the petitioner approaches the Competent Authority under the Respondents M.A.D.A with a fresh representation, her grievances shall be looked into and redressed in accordance with law as per the scheme framed for retired employees.
Having heard learned counsel for the parties, since the matter relates to post retirement dues and other service dues as also the claim for compassionate appointment of son of the deceased, at this stage, without commenting upon the merit of the claim of the petitioner, the writ petition is disposed of by giving liberty to the petitioners to approach the Managing Director, M.A.D.A, Dhanbad by filing a fresh representation within a period of 3 weeks together with all supporting facts and documents for redressal of their aforesaid grievances. On receipt of such representation, the Managing Director, M.A.D.A, Dhanbad shall consider the same in accordance with law and after verification of the service record of the deceased employee and also the criteria laid down for compassionate appointment under M.A.D.A. 2. pass a reasoned and speaking order within a period of 12 weeks, thereafter, which shall also be communicated to the petitioner.
Needless to say that if the claim of the petitioner regarding post retirement dues and other service dues of her deceased husband are found to be legally admissible and due to the petitioner, the same shall be disbursed to the petitioner along with statutory interest as per the scheme which is being made applicable to retired employees of M.ADA.
Accordingly, the writ petition is disposed of in the aforesaid terms.
