1. The present petition has been filed under Section 11 (6) of the Arbitration and Conciliation Act, 1996, (hereinafter 'Act') seeking appointment of a Sole Arbitrator for the adjudication of the disputes between the parties arising out of a Contract dated 26th February, 2019.
2. In terms of the aforesaid Contract, the petitioner awarded exclusive In-Stadia advertisement rights to the respondent for a License fee of Rs. 6,02,00,000/-. It is stated that the said Contract was executed in Delhi.
3. The aforesaid Contract contains an arbitration clause, i.e. Clause 13, which is set out below:
"13. Dispute Resolution If at any time, any question, dispute of difference arises between the DDCA and the Licensee under/or in connection with this Order, either party shall as soon as reasonably practicable give to the other notice in writing of the existence of such question/dispute of difference specifying its nature and the point of issue and the same shall be referred for ARB.P. 1106/2025 Page 1 of 3 This is a digitally signed order.

Arbitration proceedings shall be governed by the Arbitration and Conciliation Act, 1996 as amended from time to time."
4. Since there were disputes between the parties, the petitioner sent a notice dated 19th December, 2024, to the respondent under Section 21 of the Act, invoking the aforesaid arbitration clause. However, the respondent has not responded to the said notice.
5. It is stated that in these circumstances, the petitioner has been constrained to approach this Court by way of the present petition under Section 11 of the Act.
6. Notice in the present petition was issued by order dated 30th July 2025.
7. Counsel for the respondent submits that the respondent would have no objection if an Arbitrator is appointed by this Court.
8. Accordingly, the dispute between the parties under the aforesaid Contract is referred to the Arbitral Tribunal comprising of a Sole Arbitrator. The following directions are issued in this regard:
a. Ms. Sapna Chauhan (Mobile No.: +91-9811264265) is appointed as a Sole Arbitrator to adjudicate the disputes between the parties. b. The Arbitrator shall be entitled to fees as per the Fourth Schedule of the Act.
c. The Arbitrator is also requested to furnish a declaration in terms of Section 12 of the Act prior to entering into the reference. In the event there is any impediment to the Arbitrator's appointment on that count, the parties are given liberty to file an appropriate application before this Court.ARB.P. 1106/2025 Page 2 of 3

9. It is made clear that all the rights and contentions of the parties, including the arbitrability of any of the claims, and/or counter claims, any other preliminary objection, as well as claims on merits of the dispute of either of the parties, are left open for adjudication by the Arbitrator.
10. The present petition stands disposed of in the above terms.
11. Needless to state, nothing in this order shall be construed as an expression of this Court on the merits of the case.
