Heard both sides.

The petitioner apprehends his arrest in Ahiyapur P.S. Case No. 45/2013, registered for the offences punishable under Sections 406, 379, 120(B) of the Indian Penal Code.

The informant made allegation that some food grains from a Truck bearing Registration No. 25B-9345 was sent to its destination to Arambag Kutulpur, Bengal from Bazar Samiti, Muzaffarpur but the petitioner (Transporter), driver and conductor misappropriated the entire food grains.

It is submitted that the case is compromised between the informant and the petitioner.

Considering the facts aforesaid, the petitioner above Patna High Court Cr.Misc. No.29119 of 2015 (2) dt.24-07-2015 2/2 named in the event of his arrest or surrender before the court below within a period of four weeks form the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 45 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
