This miscellaneous application filed by assessee was listed on several occasions but in spite of repeated notices of hearing placed on record, none appeared on behalf of the assessee. It is evident from the record that assessee is not interested in prosecuting this miscellaneous application. Under such circumstances, we have no option but to dismiss this miscellaneous application filed by the assessee for non-prosecution by relying on the principles laid down in the decision of CIT Vs. Multiplan (India) Pvt. Ltd. 38 ITD 320 (Del.).
2. In the result, the miscellaneous application is dismissed. 2 MA No.211/Del/2011
