                     PRAYER: Criminal Revision Case filed under Section 397 r/w. 401

                     Cr.P.C., to call for the records pertaining to the order passed in

                     Cr.M.P.No.1282 of 2022 in C.C.No.67 of 2021, dated 04.05.2023 on the

                     file of the learned Judicial Magistrate, Keeranur, Pudukkottai District and

                     set aside the same.

                                                ORDER

This revision petitioners are accused in C.C.No.67 of 2021 on the file of the learned Judicial Magistrate, Keeranur, Pudukkottai District. The respondent / defacto complainant filed a complaint under 1/4 https://www.mhc.tn.gov.in/judis Crl.R.C.(MD).No.620 of 2023 Section 200 Cr.P.C., and the same was taken on file and the summon was issued and thereafter, the petitioners filed Crl.M.P(MD).No.1282 of 2022 before the Court below to discharge the case.

2. In view of the law laid down by the Hon'ble Supreme Court discharge petition filed before the learned Judicial Magistrate itself is not maintainable and hence, the learned counsel appearing for the petitioners seeks liberty to file a quash petition before this Court.

3. Hence, this Court is inclined to dispose this Criminal Revision with liberty to the petitioners to file quash petition if they are so advised.

4. Accordingly, this Criminal Revision case is disposed of Consequently, the connected Miscellaneous Petition is closed.
