               WRIT PETITION No.2059 of 2025

ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner, seeking the following relief:

"For the reasons stated in the accompanying affidavit, the petitioner herein prays that this Hon'ble Court may be pleased to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent Nos.2 to 4 in non-considering the online application vide No.2400000307, dated 6.1.2024 and non-initiating to trace-out the missing extent of land to an extent of Ac.0.07 gts in Sy.No.1383/A to an extent of Ac.0.11 gts in Sy.no.1385/A totaling to an extent of Ac.0.18 gts situated at Jagityal Revenue Village and Mandal, Jagityal District, and non-initiating to issue the e-pattadar passbooks to the petitioner, by mutating her name in all revenue records is highly illegal, arbitrary, unconstitutional, violation of Principles of Natural Justice and also in violation of Articles 14 and 300-A of the Constitution of India and consequently direct the respondent Nos.2 to 4 to consider the online application vide No.2400000307, dated 6.1.2024 and to trace-out the missing extent of land to an extent of Ac.0.07 gts in Sy.No.1383/A to an extent of Ac.0.11 gts in Sy.no.1385/A totaling to an extent of Ac.0.18 gts situated at Jagityal Revenue Village and Mandal, Jagityal District, and to issue the e-pattadar passbooks to the petitioner, by mutating her name in all revenue records and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

It is stated that the petitioner's late husband was the pattadar of agricultural land admeasuring to an extent of Ac. 0.07 guntas in Survey No.1383/A, Ac. 0.11 guntas in Survey No.1385/A, totalling Ac. 0.18 guntas, situated at Jagityal Revenue Village and Mandal, Jagityal District (for short, 'the subject land'). It is further stated that the name of the petitioner's husband was recorded as pattadar as per the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971 and Rules made thereunder and issued pattadar passbook vide Passbook No.291914 and Patta No.2662. It is further stated that after the death of the petitioner's husband, the petitioner has made an online application vide Application No.2400000307 dated 06.01.2024 requesting to mutate her name in the revenue records and to issue e-pattadar passbooks as per the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 2020 (for short, 'the ROR Act, 2020').

Learned counsel for the petitioner stated that the subject land held by her husband has devolved upon the 3 CVBR, J W.P.No.2059 of 2025 petitioner and other legal heirs and as such the petitioner has made an online application on the prescribed format vide Application No.2400000307 dated 06.01.2024 requesting the respondents to carry out necessary corrections in the passbook and issue new e-pattadar passbook after amending the extents being mentioned in the name of husband of the petitioner as per the provisions of the ROR Act, 2020.

4. Learned Government Pleader appearing for the respondents, on instructions, would submit that the petitioner has to file an application in the Dharani Portal prescribed under the provisions of the ROR Act, 2020 for correction of the entries in the revenue records.

This Court, without expressing any opinion on the merits of the case, as it is stated that the petitioner has made an online application vide Application No.2400000307 dated 06.01.2024 requesting the respondents to carry out necessary corrections in the passbook and issue new e-pattadar passbook as per the provisions of the ROR Act, 2020, the ends of justice would be met if the respondents are directed to 4 CVBR, J W.P.No.2059 of 2025 examine the application submitted by the petitioner vide Application No.2400000307 dated 06.01.2024 and if the said application fulfills all the requirements of the provisions of the ROR Act, 2020 and the circular instructions issued by the Chief Commissioner, Land Administration vide Circular No.1 of 2021 dated 15.01.2021 and Circular No.1 of 2024 dated 28.02.2024, the respondents are directed to pass appropriate orders and if, for any reason, the respondents come to a conclusion that the petitioner has not made out any case, the respondents shall pass a reasoned order within a period of two (02) months from the date of receipt of a copy of this order and communicate the same to the petitioner.

6. With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous applications pending, if any, shall stand closed.
