The petitioners have filed the present petition inter alia with a prayer for issuance of directions to official respondents to protect life and liberty of the petitioners from the hands of private respondents No.6 to 8 and not to interfere in their married life.
It has been averred that the date of birth of petitioner No.1 is 05.06.1991 while date of birth of petitioner No.2 is 06.09.1995. Copies of Aadhar Cards of petitioner Nos.1 & 2 to this effect are attached as Annexures P-1 and P-2 respectively.
It has been submitted that earlier also petitioner No.1 was married with Pawanpreet Kaur daughter of Gurdeep Singh-respondent No.6, however, after 15 days of the marriage Pawanpreet Kaur had gone to Australia with the entire expenses for sending her abroad being borne by the family of petitioner No.1. Later on said Pawanpreet Kaur and her family members hatched a conspiracy and cheated on petitioner No.1. In this regard, petitioner No.1 has got lodged FIR No.35 dated 20.05.2021, under 1 of 2 ::: Downloaded on - 07-06-2023 23:18:11 ::: Neutral Citation No:= CRWP No.2063 of 2023 2 Sections 420, 120-B IPC at Police Station Balianwali District Bathinda against his first wife-Pawanpreet Kaur and respondents No.6 and 7. An ex- parte decree/order of divorce has also been passed against petitioner No.1 by the Federal Circuit Court of Australia vide order dated 02.06.2021 (Annexure P-5). Petitioner No.2 is fully aware of the marriage of petitioner No.1. Thereafter, the petitioners are going to solemnize the marriage on 26.03.2023. Private respondents are opposed to the marriage. The petitioners have submitted representation dated 27.02.2023 (Annexure P-6) to respondent Nos.2 and 3-the Senior Superintendent of Police, Bathinda, and Senior Superintendent of Police, Ferozepur, seeking protection of their lives and liberty at the hands of the private respondents.
Without expressing any opinion on the merits of the matter and in particular the legality of the alleged relationship, the present petition is disposed of with a direction to respondent No.2-the Senior Superintendent of Police, Bathinda and respondent No.3-the Senior Superintendent of Police, Ferozepur, to forthwith consider the aforesaid representation dated 27.02.2023 (Annexure P-6) made on behalf of the petitioners and thereafter, take appropriate action on the same as is deemed fit in accordance with law to ensure the protection of life and liberty of the petitioners.
It is made clear that this order shall not be taken to validate the alleged relationship between the petitioners or protect them from legal action for violation, if any, committed by them.
