Petitioners claim that they have married against the wishes of their family members. Apprehending threat to their life and liberty, they have filed the present petition for protection.
Learned counsel for the petitioners has submitted that petitioner No.1-Sameena Bibi is of the age of 17 years but under the Muslim law she may marry after the age of 15 years.
Petitioners claim to have submitted a representation (Annexure P-6) dated 27.08.2021, in this regard to the Senior Superintendent of Police, Hoshiarpur.
Heard. Record perused.
Notice of motion to the office of Advocate General, Punjab. Mr. Randhir Singh Thind, DAG, Punjab, accepts notice on behalf of the State. Copy stands supplied.
Petitioner No.1 has placed on record her date of birth 1 of 2 ::: Downloaded on - 04-09-2021 01:38:10 ::: CRWP-8331-2021 -2- (Annexure P-2) and petitioner No.2 has placed on record his 'Aadhar card' (Annexure P-3) as proof of their age and certificate (Annexure P-4) regarding performance of marriage.
This petition is disposed of with a direction to respondent No.3- SHO, Police Station Hajipur Mukerian, District Hoshiarpur, Punjab that representation, if any, filed seeking protection of life and liberty, be got looked into and contents thereof be duly verified and if necessary, requisite steps be taken, strictly in accordance with law for grant of protection of life and liberty to the petitioners. It is made clear that this order shall not be treated as a stamp of this Court regarding validity of marriage of the parties.
