12/10/2022 Shri Roop Ram Naik, Counsel for the Applicant.

Shri Ali Asgar, Dy. A.G. for the State/respondent.

Heard on I.A. No. 01/2022 which is an application for grant of ad-interim bail to the applicant.

The applicant is apprehending her arrest in connection with Crime No. 396/2022 registered at Police Station- Koni, District- Bilaspur, (C.G.) for commission of the offence punishable under Sections 498-A, 294, 323, 506,34 of IPC.

Prosecution story in brief, is that, complaint has been lodged alleging that the present applicant along with other co- accused persons harassed the complainant physically and mentally on account of demand of dowry. It is also alleged that the accused persons used to threaten the complainant and also made attempt to commit murder of the complainant by pouring kerosene on her. Therefore, FIR has been registered against the applicant.

Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in the case. He further submits that the present applicant is aged about 52 years and she is suffering from various ailments and, therefore, she is advised to take rest and in support of which, medical documents have been annexed therein as 'Annexure A/4', therefore, she may be granted benefit of ad-interim bail.

On the other hand, learned counsel for the State opposes the ad-interim bail application of the applicant.

After considering all the facts and circumstances of this case, I feel inclined to allow this application.

Accordingly, application for grant of ad-interim bail is allowed. It is directed that the applicant shall be released on ad-interim bail on her furnishing a personal bond in sum of Rs.25,000/- with one local surety in like sum to the satisfaction of the concerned trial Court, till the final disposal of the present case.
