1. Rule. Mr. Rakesh Patel, learned AGP waives service of notice of Rule  on behalf of respondent No. 1 to  3.

2. By way of present application, the applicants have prayed as under:

[A] Your   Lordships   may   be   pleased   to   allow   this   application   and   be  pleased   to  permit   the  applicants   No.1/1   and   1/2   as   the   heirs   and  legal  representatives   of   the   deceased   Kalubhai   Gopalbhai   Patel.   Delay   may  pleased be condone 01 day.

3. Since no notice is issued to the other side, it is not necessary to call  upon to reply this civil application. 

4. Having heard learned advocate and considering the averments made  in the application, I am of the opinion that the present application requires  to be allowed  and accordingly  is allowed  in terms  of  Para 3[A].  Rule is  made absolute.
