This is a petition filed under Section 25 of the Code of Civil Procedure, 1908 (for short “CPC”). The petitioner is the wife of the respondent. The petitioner has filed this transfer petition seeking the following reliefs:

“A) Allow the present petition and transfer the petition bearing MAT Suit No.35 of 2024 under Section 9 of the Hindu Marriage Act, 1955 for restitution of conjugal rights, titled Gyanadipta Rout vs. Rashmi Rout, before the Court of the Civil Judge, Senior Division, Koraput to Principal Judge Family Court, Saket, New Delhi and/or;

Having heard learned counsel for the petitioner and learned counsel for the respondent and on perusal of the material on record, we find that the petitioner has made out a case for transfer of the aforesaid petition.

In the result, the Transfer Petition is allowed and the petition bearing MAT Suit No.35 of 2024 titled as “Gyanadipta Rout vs. Rashmi Rout”, pending before the Court of Civil Judge, Senior Division, Koraput is transferred to the Court of Principal Judge, Family Court, Saket, New Delhi.” Registry to communicate this order to the transferee and transferor courts for taking steps in accordance with this order.

As the petitioner herein has also filed a petition under Section 9 of the Hindu Marriage Act, 1955 seeking restitution of conjugal rights, the respondent-wife is at liberty to reside with the petitioner at Koraput, Orissa along with the minor child by reconciling all differences with the petitioner-husband.
The petitioner-husband is also at liberty to visit the respondent-wife and the minor child who are presently residing with her parents at Delhi so as to reconcile all differences.
