(2)When, from the extent, situation or construction of such works, it is necessary that they should continue the joint property of the proprietors of two or more of the portions into which the estate may be divided, the Collector shall determine the extent to which the proprietor of each portion may use the said works and the proportion in which the charges for repairs thereof shall be borne by such proprietor and the manner in which the profits (if any) derived therefrom shall be divided.
