ORDER
PER BENCH:
These six appeals bearing numbers 73 to 78/Alld./2017 for assessment years (ay's): 2007-08 to 2012-13 had been filed by assessee before Income Tax Appellate Tribunal, Allahabad, U.P. ( hereinafter called "the tribunal") against separate appellate orders passed by ld. Commissioner of Income-tax(A)-III, Lucknow , all dated 28.02.2017. These six appeals were heard through video conferencing mode through Virtual Court.
2. The ld. Counsel for the assessee CA , Shri Gaurav Bansal appeared before the Bench and made statement before the Bench that the assessee in all these six years(ay's:
2007-08 to 2012-13) have made an application in Form No. 1 and 2 before the Revenue ITA Nos.73 to 78/ALLD/2017 Jeevan Jyoti Institute of Medical Sciences for availing Vivad Se Viswas Scheme, 2019 and ld. Pr. CIT has already issued Form No.
3 for all these six ay's . The ld. Counsel for the assessee drew our attention to an email/letter sent by him to tribunal on 25th January 2021 , which letter/email was marked to the Bench ( the said email/letter is placed on record in file), in which ld. Counsel for the assessee has stated that the assessee has filed Form Nos. 1 and 2 with the department availing Vivad Se Vishwas Scheme , 2019 and Form No. 3 has already been issued by learned Pr. CIT under the Vivad Se Vishwas Scheme , 2019 for all these six assessment years , and it is stated that in view of the above the assessee does not wish to pursue these aforesaid six appeals. The ld. AR made prayers before the Bench for withdrawal of all the above mentioned six appeals filed by the assessee with the tribunal. The ld. CIT- DR did not raise any objection if all these six appeals filed by the assessee are dismissed as being withdrawn.

In view of the fact that the assessee has already approached the Department to settle its dispute and outstanding dues under the Vivad Se Viswas Scheme,2019 as stated by learned counsel for the assessee before the Bench and also in its email/letter dated 25.01.2021 as detailed above and Revenue raising no objection to dismissal of all these six appeals being withdrawn, therefore, the present appeals of the assessee are allowed to be withdrawn and consequently the same are dismissed being withdrawn. We order accordingly
4. In the result, all the six appeals filed by the assessee in ITA no. 73 to 78/Alld/2017 for ay: 2007-08 to 2012-13 are dismissed as withdrawn. .
Order pronounced in the open Court in the presence of both the parties after conclusion of hearing on 27 /01/2021 through video conferencing .
