B.S. Walia, J. (VC) [1] Prayer in the petition under Sections 11 & 12 of the Contempt of Courts Act, 1971, is for initiating proceedings against the respondents for intentional and willful defiance of order dated 07.05.2021 in CWP No.9555 of 2021.
[2] A perusal of order (Annexure P-1) reveals that CWP No.9555 of 2021 was disposed of vide order dated 07.05.2021, by granting liberty to the petitioners to file separate comprehensive representations for seeking relief of their grievances as had been highlighted in the writ petition in the light of policy dated 19.04.2017 within 01 week of the date of order and in case representation was received, the Chief Administrator, Haryana Shahari Vikas Pradhikaran, Panchkula, was to consider and decide the same within 06 months in accordance with law. [3] Learned counsel contends that the instant petition was filed on account of failure of the respondent to take a decision within the 1 of 2 ::: Downloaded on - 03-02-2022 20:59:29 ::: COCP No.1430 of 2021 -2- stipulated period of time but during the pendency of the petition, respondent No.2 has taken a decision on the representation submitted by the petitioners vide order dated 15.07.2021 and copy thereof communicated to the petitioners and in the circumstances, the petitioners grievance having been redressed, the petitioners are not interested in pursuing the contempt petition and the same may be disposed of as such. [4] I have considered the submissions of learned counsel for the petitioners, affidavit filed by respondent No.2 in compliance of order dated 07.05.2021 in CWP No.9555 of 2021 as also the statement of learned counsel for the petitioners, and in the circumstances am of the view that no action under the Contempt of Courts Act, 1971 is called for against respondent No.2.
[5] Accordingly, the contempt is disposed of as such.
