01. 1. Heard Mr. Das, learned counsel for the petitioner and Ms. Nayak, learned ASC for the State.

2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Ragudi P.S. Case No.147 of 2025 corresponding to G.R. Case No.1251 of 2025 pending in the file of learned J.M.F.C., Barbil on the grounds stated therein.

3. Gone through the contents of the FIR at Annexure-1 and the Court finds that the vehicle was found involved in illicit transportation and was intercepted by the officers of the OMDC. The further submission is that the petitioner was not driving the alleged vehicle at the relevant point of time. It is further submitted that the petitioner drives the four-wheeler at times and, hence, he apprehends his arrest by the local police.

4. Recorded the objection of the State.

5. From the FIR at Annexure-1, it is made to suggest that the vehicle in question was left at the spot and its driver managed to flee. The plea of the petitioner herein is that he was not driving the vehicle i.e. Mahindra Pickup Van at the time of its interception. Recording the objection of the State and the above plea of the petitioner, this Court though not inclined to grant pre-arrest bail but is of the view that the petitioner should be released on bail upon surrender before the court concerned with suitable conditions.

6. Accordingly, it is ordered.

7. In the result, ABLAPL stands disposed of with the direction as aforesaid. It is further directed that in the event the petitioner surrenders before the court of learned J.M.F.C., Barbil within a fortnight from today, he shall be released on bail in connection with Ragudi P.S. Case No.147 of 2025 corresponding to G.R. Case No.1251 of 2025 subject to him furnishing a bail bond of Rs.30,000/- (Rupees thirty thousand) with one solvent surety for the like amount to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall cooperate the I.O. during investigation of the case. It is further directed that the above order shall not be given effect to if the plea of the petitioner not being the driver of the alleged vehicle is found false upon verification of the relevant Page 2 of 3 documents submitted by the I.O. with an enquiry held in that regard.

8. Issue urgent certified copy as per rules.
