Heard the learned counsel for the parties.         The applicants are apprehending their arrest in connection with Crime No.759/2014 registered at Police Station Kotwali, Khandwa for the offences punishable under Sections 498-A, 323, 324/34, 506 of IPC and Sections 3/4 of Dowry Prohibition Act.         Learned counsel for the applicants submits that the applicants are reputed citizen of the locality, who have no criminal past alleged against them. The complainant is the daughter-in-law of the applicants No.2 & 3 and wife of the applicant No.1, whereas applicants No.4 and 5 are brother and sister of the applicant No.1.

The case is triable by the Court of JMFC and therefore it is not so grave. The complainant has submitted an affidavit in support of the applicants and she is residing with the applicant No.1 peacefully. Nothing has to be seized from the applicants.  The police is unnecessarily harassing the applicants. Under these circumstances, they pray for bail of anticipatory nature.                      Learned counsel for the State opposes the application.         Keeping in view the submissions made by learned counsel for the parties and the facts and circumstances of the case, without expressing any opinion on the merits of the case, I am of the view that the applicants have a good case for grant of bail of anticipatory nature. Consequently, the application under Section 438 of Cr.P.C. is hereby allowed. <span style="font-size:14.0pt;line-height:

"Bitstream Vera Serif"">       It is directed that in the event of arrest, present applicants namely Chandra Shekhar, Babulal Silawat, Narmada Bai Silawat, Onkar Silawat and Jyoti Silawat shall be released on bail on their furnishing a personal bond in the sum of Rs.25,000/- (Rupees twenty five thousand) each with a solvent surety in the like amount to the satisfaction of the Arresting Authority.         This order shall be operative if the bail bonds are furnished before the Arresting Authority within one month from today.         The applicants shall make themselves available for interrogation by a police officer as and when required. They shall further abide by the other conditions enumerated in sub-Section (2) of Section 438 of Cr.P.C. In view of the ratio laid down by the Hon'ble Apex Court in the case of %u201CSidharam Satlingappa Mhetre Vs. State of Maharashtra and others%u201D, (AIR 2011 SC 312), it is directed that this order shall remain in force till the end of the trial, if the applicants furnish the bail bond and surety bond before the Court below at the time of filing of challan as per the terms and conditions as mentioned above.          However, it is made clear that due to non-appearance of the applicant(s) if the concerned Court issues a warrant of arrest in future, against the applicant(s), then in such event this order be deemed ineffective relating to that applicant(s).<span style="font-size: 14.0pt;line-height:150%;font-family:"Bookman Old Style","serif";mso-fareast-font-family:
