1. Mr. Kumbhakoni, learned Senior Counsel appearing for Respondent - BMC, on the prior date i.e. 16 February 2026, sought for the matter be stood over in view of the new budget likely to be presented by the end of February 2026, which, according to his submission, would impact the present proceedings. Accordingly, the matter was stood over and has been taken up today.

2. Mr. Kumbhakoni has submitted today that the new State budget has come up, and a sum of Rs. 1,000 crore for the financial year 2026-2027 has been provided for B.E.S.T.
3. Mr. Kumbhakoni, learned counsel appearing for the Respondent states that as per the order dated 4 December 2024, the co-ordinate Bench of this Court had directed payment of second installment of 35% of the amount. The payment of first installment, being 30% of the total amount, has already been paid. Out of the entire second installment, which was to be achieved until 28 February 2026, an amount of Rs. 8.37 crore, remains.
4. He has submitted that upon the Respondent - BMC releasing the said sum of Rs. 8.37 Crore by 31 March 2026, it shall be paid to the Petitioner by 7 April 2026. This statement is accepted.
5. Mr. Kumbhakoni has also assured this Court that such balance amount of Rs. 8.37 Crores shall be released by Corporation - BEST by 31 March 2026.
