Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with the case registered under Sections 47(a) 21(F) of the Excise Act.

Learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case merely because he happens to be the landlord of the house from where stolen recovery of illicit liquor and other related items were made. It is also submitted that petitioner has leased out the house in question to one Santosh Mahto much before the alleged date of occurrence.

Learned A.P.P has opposed the prayer for anticipatory bail. In the fact and circumstances of the case, the above named petitioner is directed to surrender in the Court below within three weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Deoghar in connection with G.O.C.R Case No. 296 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, and subject to the further condition that on the date of surrender petitioner shall deposit Rs. 5,000/- in the trial Court.

The aforesaid deposit is subject to the result of the case.
