DATE : 04 FEBRUARY 2019. P.C:- . Learned Counsel for applicant filed praecipe for fixing
early date of hearing. He submits that by this civil application they are seeking permission to allow the applicant to bring legal heirs on record of deceased-respondent. He submits that earlier also he has filed praecipe for fixing the matter on board. He submits that civil application was not shown on board because the papers of writ petition No.12645 of 2016 were not available in the registry. Considering these facts, following order is passed :
a) Applicant to remove all office objections on or before 20.02.2019, failing which civil application stands dismissed without reference to the Court.
b) Applicant to serve the Respondent by private notice along with entire proceeding either by RPAD and or S.C.Magar Page 1 of 2 ::: Uploaded on - 06/02/2019 ::: Downloaded on - 15/03/2019 23:24:40 ::: m12-cast-6912-2018.doc by hand delivery and file affidavit of service to that effect on or before 22.03.2019.
c) If affidavit of service is filed within time, matter to appear on board on 18.04.2019, otherwise as per CMIS date.
