                                   ORDER

1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Life Insurance Corporation of India, Kanpur. The appellant seeking information on two points and it sub-points, including, inter-alia:-

(i) Certified copy of document for the LIC policy no. 237801288;
(ii) Certified copy of final payment release order of LIC of late Shri Abhishek Jain;
(iii) Certified copy of details of registered agent for selling of the said policy to Mr. Abhishek Jain, etc.

2. As the CPIO had not provided the requested information, the appellant filed the first appeal dated 15.09.2019 requesting that the information should be provided to her. The first appellate authority was ordered on 27.09.2019 and disposed of her first appeal. She filed a second appeal u/Section 19(3) of the RTI Act before the Commission on the ground that information has not been Page 1 of 3 provided to her and requested the Commission to direct the respondent to provide complete and correct information.

Hearing:

3. The appellant attended the hearing through audio-call. The respondent, Mrs. Ramakanti, CPIO attended the hearing through audio-call.

4. The respondent submitted their written submissions dated 21.06.2021 and the same has been taken on record.

5. The appellant submitted that no information has been provided to her by the respondent on her RTI application dated 21.08.2019. The appellant submitted that being the legally wedded wife of Late Shri Abhishek Jain, the respondent has wrongly denied the information to her on her RTI application. She submitted that complete and correct information should be provided to her.

The respondent submitted that vide their letters dated 11.09.2019 and 27.09.2019, they have categorically informed the appellant that the information sought by her is personal information of third party and is exempted from disclosure under Section 8(1)(e) and 8(1)(j) of the RTI Act. The respondent has further informed that the appellant is not the nominee in the said policy of Late Shri Abhishek Jain. The mother of Late Shri Abhishek Jain is the nominee to whom the payment has already been made.

Decision:

The Commission, after hearing the submissions of both the parties and after perusal of records, observes that the respondent has categorically informed the appellant on her RTI application that the information sought by her is personal information of third party and is held by them in fiduciary capacity, therefore, the same is exempted from disclosure under Section 8(1)(e) and 8(1)(j) of the RTI Act. The Commission is of the view that the information sought by the appellant is third party information and is exempted from disclosure under Section 8(1)(j) of the RTI Act. The Commission is satisfied with the action/steps taken by the respondent in dealing with the RTI application of the appellant. Hence, no further intervention of the Commission is required in the matter.
8. With the above observations, the appeal is disposed of.
