TEJINDER SINGH DHINDSA.J The petitioner, who was serving as Additional Director under the Department of Industries & Commerce, State of Punjab retired on 30.9.2010 upon attaining the age of superannuation. In terms of the averments made in para 5 of the writ petition the retiral benefits in the nature of leave encashment, G.P.F, D.C.R.G, G.I.S. Etc. have been released after a delay ranging from 41 days to 192 days.

Learned counsel for the petitioner contends that the petitioner had an unblemished record of service and no departmental proceedings had either been initiated or were pending as on the date of retirement of the petitioner. Counsel, accordingly, argues that the petitioner is vested with a right to claim interest on such delayed release of retiral benefits. Counsel further points out that even a legal notice dated 11.1.2012 (Annexure P-10) already stands served upon the respondent-authorities.

In the light of the averments made in the petition, I deem it appropriate to dispose of the present petition with a direction to respondent no.2 to consider the claim of the petitioner and decide the legal notice dated 11.1.2012 (Annexure P-10) strictly in accordance with law and by passing a speaking order within a period of eight weeks from the date of receipt of a certified copy of this order.

Petition disposed of.
