39. Appointment and remuneration of acting Commissioner. - During the absence on leave or other temporary vacancy in the office of the Commissioner, the [State] Government may appoint a person to act as Commissioner and every person so appointed shall exercise the powers and perform the duties conferred and imposed by this Act or any other law for the time being in force on the Commissioner, and shall be subject to all the liabilities, restrictions and conditions to which the Commissioner is liable and shall receive such monthly salary not exceeding the salary for the time being payable to the Commissioner as the [State] Government shall determine.
