1. When these matters were listed for 'admission', considering that Jaipur Bench of this Court has passed interim orders in a bunch of identical writ petitions led being S.B.Civil Writ Petition No.13994/2022 : Rajkumar Bairwa Vs. State of Rajasthan, ex-
parte interim orders were passed in most of these cases in order to maintain parity:-
"Meanwhile, the petitioner shall be permitted to appear in document verification to be conducted by the Rajasthan Staff Selection Board in relation to recruitment of the Basic Computer Instructor.
It will be required of the Staff Selection Board to notify the date of document verification latest by 31.12.2022 and the document verification shall be held latest by 15.01.2023."

Mr. Sanadhya, learned counsel appearing for the Selection Board argued that since the petitioners have raised objection about the correctness of the final answer key published by the Selection Board in relation to a number of questions (27), the decision of these petitions is likely to take some time and if during such period, the interim orders are allowed to be continued, it would disturb the complete selection process.

He highlighted that many petitioners who otherwise fell much below the cut of marks have also approached this Court (Downloaded on 09/01/2023 at 11:29:20 PM) (23 of 25) [CW-13762/2022] raising frivolous challenge to umpteen number of questions and interim orders have been passed in all such petitions.
4. He submitted that conducting document verification of each and every candidate who approaches this Court irrespective of the marks obtained by him and without considering the substance of the challenge laid is a cumbersome and wasteful process, therefore, the interim orders granted in petitioners' favour be vacated.
5. He submitted that the Selection Board is under a legal obligation to conduct document verification of all the petitioners who are approaching the Court at regular intervention and regardless of the fact that document verification has been conducted, the petitioners fate would still be in limbo as their names obviously would not come in the list of candidates called for document verification.
6. Heard learned counsel for the parties.
7. In the opinion of this Court, the document verification is not an empty formality.
8. As per the terms of the assessment, document verification is to be conducted only qua those candidates who have been found meritorious pursuant to the written examination.
9. Maybe, the petitioner(s) has/have some substance in relation to objections to answer key, but simply because such answer key has been challenged, the Selection Board cannot be mandated to conduct document verification.

That apart, if the petitioners objection qua a particular question or questions is sustained, then, as a natural concomitant entire result has to be quashed and consequently, (Downloaded on 09/01/2023 at 11:29:20 PM) (24 of 25) [CW-13762/2022] the list of candidates selected for document verification will to be revisited/revised.

Unnecessarily burdening the Selection Board by directing to conduct document verification of each and every petitioner, not only affects administration of the Selection Board, but also gives rise to false hope to the petitioners/candidates and creates confusion and uncertainty in the entire selection process.
12. Therefore, this Court is of the firm view that document verification cannot be ordered unless candidates' names appear in the merit list. Exercise of document verification can be undertaken subsequently also, if deemed necessary.

In view of the aforesaid, the interim orders passed in all these writ petitions are vacated and the stay applications stand disposed of with the clarification that the merit list published by the respondent - Selection Board on 31.08.2022 shall remain subject to outcome of the present writ petitions.

In case, the Selection Board proposes to issue final select list, it can do so but the list so issued shall clearly contain a note that the appointments are subject to pendency of a bunch of present writ petitions led by Suseel Kumar Vs. State of Rajasthan : S.B.Civil Writ Petition No.13762/2022.
15. List these cases on 20.01.2023.
16. The petitioners are directed to supply copy of the writ petitions to Mr. Vinit Sanadhya, (if not already supplied).
