I.A. NO. 25505 OF 2023 Heard Mr. Rajesh Srivastava, the learned counsel appearing for the petitioners. Also heard Mr. Trilok Nath Saxena, the learned counsel appearing for the respondents.

No. 25505 of 2023 is filed alleging that certain constructions are going on in the suit property and therefore 1 interim order be passed. On this, Mr. Rajesh Srivastava, the learned counsel would submits that a small construction under the Pradhan Mantri Aawas Yojna is being carried on in the suit property. It is further submitted that Civil Suit No. 47 of 2023 in respect of the very same property involved in this case is pending in the Court of Civil Judge, Joginder Nagar, District Mandi, Himachal Pradesh.

Considering the above, the respondents are granted four weeks time to file an affidavit on the nature of the construction and also an undertaking in the event the case verdict going against them, they are prepared to remove the construction.
