1. Heard.

2. The trial Court has acquitted the accused of the charge of committing murder of his wife Bisahin alias Jarheen Bai.

3. The accused and the deceased were living together in the house where the dead body was found. Pawan Kumar (PW- 2 CRMP No. 1486 of 2019

1) who is son of the appellant and the deceased has supported the extra-judicial confession made by the accused.

4. Having seen the evidence we are inclined to grant leave to appeal to the accused.

5. Accordingly, prayer for leave to appeal is allowed. The CRMP is disposed of.

6. Let regular acquittal appeal be registered and notice thereof be sent the respondent on payment of process fee as per rules.

7. Bailable warrant of arrest for a sum of Rs.25,000/- be issued against the respondent for his appearance before this Court on 23.09.2019.
