1. By order dated 07.02.2023, the Supreme Court has dismissed SLP(C) 23311/2019 [National Highways Authority of India vs. M/s BLA Projects Pvt. Ltd.], filed by the judgment debtor in respect of a challenge to the award under enforcement. The order reads as follows:-
"Having heard the learned senior counsel for the petitioner as also the learned counsel for respondent and having taken note that the award passed by the learned arbitrator dated 31.08.2018 has been upheld proceedings under section 34 of Act as also Section 37 of the Act. We see no reason to interfere. However, on the question with regard to the operation of the clauses in the contract and the reference to DRE i.e Dispute Review Expert is left open to be considered in appropriate case, if it arises.

The amount in deposit before the Delhi High court along with accrued interest, if any, shall now be released to the respondents."
2. In view of the aforesaid order, learned counsel for the parties are ad idem that no further orders are required in these execution proceedings except to direct that the amount deposited by the judgment debtor, alongwith accrued interest, be released to the decree holder. The Registry is directed to do so within three weeks from today.
3. The execution proceedings are, therefore, disposed of with these directions.
