These matters were Part Heard and listed today for Mr. Cama and the other counsel, supporting Mr. Cama's line of arguments, to address this Court on the Full Bench decision of this Court in the case of Nandkishor Pralhad Byawahari vs. Mangala w/o Pratap Bansar 1 and for other Counsel to present their contra point of view.
2 When the arguments in these matters has just commenced this afternoon, Mr. Cama appears and informs this Court that in view of the reference made to a Special Bench of this Court pursuant to an order dated 8 th August, 2023 in Criminal Application No.143 of 2023 along with connected matters, the Special Bench hearing the said applications has expressed inclination to refer the very same question as raised in the applications before this Court to a larger Bench and, therefore, it would not be necessary to continue this hearing. 3 In this view of the matter, list on 27th October, 2023, for considering the interim relief in each of the applications.
