             UPON hearing counsel the Court made the following
                                 O R D E R

Prayer (a) does not survive in view of the events that have taken place subsequent to the filing the Writ Petition.

As regards prayer (b), Mr. Sidharth Luthra, learned Additional Solicitor General appearing for respondent No. 2 - Commissioner of Police, prays for short time to seeks instructions and inform the Court on the two queries - (a) Why despite the prohibitory order under Section 144 of the Code of Criminal Procedure, 1973 (for short, ’Code’), the law enforcing machinery/police permitted five or more persons to assemble unlawfully and (b) Whether law enforcing machinery/police acted appropriately and with utmost expedition in dispersing the unlawful assembly under Section 129(2) of the Code after such assembly was informed under Section 129(1) to disperse and despite such command the assembly did not disperse.

List the matter on January 31, 2014.
