4 22-07-2014

Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant, who has suo motu appeared.

The petitioner seeks bail in Laukahi P.S. Case No. 92 of 2013 dated 31.08.2013 instituted under Sections 363 / 364 / 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., and further that nothing incriminating has been recovered from him and only in the confessional statement, role has been assigned to him.

Learned A.P.P., upon going through the case diary, and learned counsel for the informant submit that from the confessional statement, it is apparent that the role assigned to the Patna High Court Cr.Misc. No.24419 of 2014 (4) dt.22-07-2014 2/2 petitioner is plausible and described in detail.

Considering the facts and circumstances of the case and the submissions of the learned counsels for the parties, the Court is not inclined to enlarge the petitioner on bail. Accordingly, the application stands dismissed.

However, the court below shall expedite the trial and conclude the same within nine months.

(Ahsanuddin Amanullah, J) Dilip.
