                      1)             By this Petition under Article 226 of the Constitution of India, the

Petitioners are seeking the relief of quashing of MECR No.2 of 2021 dated 18th May 2021 registered with Bandra Police Station for the offences punishable under Sections 415, 420, 465, 468, 469, 470, 471, 120B read with 34 of the Indian Penal Code, with the consent of Respondent No.2.

2) Petition was initially filed for quashing of the said case on merits. However, in the interregnum, the Petitioner and Respondent No.2 have put an end to their disputes and differences and Respondent No.2 is now giving his consent for quashing of crime in question.

3)               Learned Advocate appearing for Respondent No.2 tendered

across the bar his Affidavit dated 19 th November 2025, duly affirmed before the Assistant Registrar of this Court. In paragraph No.5 thereof, the Respondent No.2 has stated that, in light of the subsequent understanding and to give a complete quietus to the present dispute, he does not wish to press the allegations made in his Complaint dated 13 th May 2021 and other consequent proceedings. In paragraph No. 6 thereof, the Respondent No.2 has given his no objection for quashing of the said case. 3.1) Though, the Respondent No.2 is not personally present in the Court, Advocate Mr. Nimbalkar on instructions submitted that, the Respondent No.2 has given him authority to admit the contents of his Affidavit dated 19th November 2025 and to give his 'No Objection' for quashing of the crime in question.

4) In view of the above, we are inclined to quash MECR No.2 of 2021, dated 18th May 2021, registered with Bandra Police Station for the offences punishable under Sections 415, 420, 465, 468, 469, 470, 471, 120B read with 34 of the Indian Penal Code.

4.1) As we expressed our opinion for quashing of said criminal case, Mr. Desai, learned senior counsel for Petitioners on instructions submitted that, for quashing of the said crime, the Petitioners will voluntarily pay a cost of Rs.50,000/- each, totalling to Rs. 2,50,000/-, jointly or severally to the Bar Council of Maharashtra and Goa's Advocate Academy and Research 2/4 ::: Uploaded on - 16/12/2025 ::: Downloaded on - 19/12/2025 21:32:54 ::: Ingale 3-WP-2051-2021.doc Center, within a period of two weeks from the date of uploading of the present Order on the official website of the High Court of Bombay. The said statement is accepted as an undertaking given to this Court. 4.2) We therefore direct the Petitioners to pay a cost of Rs.50,000/- each, totalling to Rs. 2,50,000/-, jointly or severally to Bar Council of Maharashtra and Goa's Advocate Academy and Research Center within a period of two weeks from the date of uploading of the present Order on the official website of the High Court of Bombay.

4.3) Details of the bank Account for payment of cost are as under:-

5) In view of the above and subject to payment of cost, Petition is allowed in terms of prayer clauses (a) & (b).

7) List the Petition on 7th January 2026, under the caption 'For Reporting Compliance' of present Order.
