02/20.07.2015Seeking quashing of result of TET2012 in so far as, the petitioner is concerned, the present writ petition has been filed.
2. The petitioner is working as parateacher in upgraded primary school, Jabdiya since 2002. The petitioner appeared in TET Examination on 26.04.2013 and the result was published on 28.03.2013. The petitioner's result has been declared as "status rejected".
3. The learned counsel for the petitioner submits that on a technical ground, petitioner's candidature has been rejected. The learned counsel for the petitioner refers to order passed in L.P.A. No. 450 of 2013 and submits that in an identical case, a direction was issued to the respondentJharkhand Academic Council to consider the representation of the applicant however, petitioner's representation has not been considered by the respondentJharkhand Academic Council.

4. Mr. M. Sohail Anwar, the learned Senior counsel for the respondentJAC submits that the entire process of evaluation of OMR sheet of TET Examination was undertaken through a fully computerised system. Any omission to darken bubbles would disqualify the candidate. The petitioner's candidature has been rejected on the ground that he failed to darken the bubble in QBSE.
5. It is not in dispute that the petitioner has failed to darken the bubble in QBSE. In his representation dated 04.06.2013, the petitioner has admitted the said fact. Failure to fill up/darken relevant column/bubble is not a minor technicality. The learned counsel for the respondentJAC has rightly contended that no manual interference is permissible as the entire process of evaluation is undertaken through a fully computerised system. In case OMR sheet is not completely fill up, the computer would automatically reject the same and the OMR sheet of such a candidate would not be evaluated. The reliance placed by the learned counsel for the petitioner on order passed in L.P.A. No. 450 of 2013 is misplaced. The case pleaded by one Uttam Kumar Mondal in the said case was entirely different from the facts in the present case.
6. Considering the objection taken by the respondentJAC, I am not inclined to interfere in the matter and accordingly, the writ petition is dismissed.
